ARIZONA, APPROVING A REZONE REQUEST BY BCIF GROUP, TO REZONE
APPROXIMATELY 297 ACRES OF LAND GENERALLY LOCATED ON THE EAST SIDE OF
I - AT THE TRICO- MARANA INTERCHANGE, NORTH OF THE MARANA. ESTATES
SUBDIVISION, IN THE NORTHERN ONE -HALF OF SECTION 22, T1 I S, RI I E, FROM "ZONE
L," TO APPROXIMATELY 15 ACRES OF "VC" (VILLAGE COMMERCIAL), 11 ACRES OF
"CO" (COMMERCIAL), 85 ACRES 44 R -6," 71 ACRES "R -7," 82 .ACRES "R.-S," AND 29 ACRES
"R -144," ASSES PARCEL NUMBERS 217- 27 -002H, r, K L AND 21729 -0020.
WHEREAS, BCIF Group is the owner of approximately 297 acres of land generally located
on the east side of I-10, at the Trico- Marana interchange, north of the Marana Estates subdivision,
as depicted on Exhibit A, attached hereto and incorporated herein by this reference, and are more
specifically described as being in the northern one -half of Section 22, T I 1 S, RI I E; and
WHEREAS, BCIF Group has requested a rezone of the 297 acre property from zone "E,"
to approximately 15 Acres of "VC" (Village Commercial), I 1 acres of "CO" (Commercial), 85 acres
"R -6," 71 acres "R-7," 82 acres "R -8," and 29 acres "R -144," rezoning requests more particularly
described in Exhibit B, attached hereto and incorporated herein by this reference; and
WHEREAS, in reviewing the rezoning request, Staff recommended to the Planning and
Zoning Commission the approval of the rezoning request subject to sixteen conditions; and
WHEREAS, the Marana Planning Commission, after a public hearing, considered this
request for a rezone on May 31, 2000, and voted 4 -3 to recommend that the Town Council approve
said rezone, adopting sixteen conditions; and
WHEREAS, the Marana Town Council heard from the representative of the owner, staff and
members of the public at the regular Town Council meeting held December 19, 2000, and has
deten that the rezone is in conformity with the General Plan and should be approved.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana,
Arizona, as follows:
Section 1. The zoning of approximate) 297 acres of land g enerally located on the east side of I -10 .

at the Trico- Marana interchange, north of the Marana Estates subdivision in the northern one -half .
of S ection 22, T 11 S, R 1 I E, is hereby changed from "zone E," to approximate) y 15 acres of "VC"
(Village Commercial), 11 acres of "CO" (Commercial), 85 acres "R -6," 71 acres "R-7," 82 acres "R-

8," and 29 acres "R -144," Assessor's Parcel Numbers 217- 27 -002H, J, K, L and 217 -29 -0020, as
more particularly described in Exhibit B, attached hereto.
Section 2. The purpose of this rezoning is to promote the development of the San Lucas Master -
planned Community, subject to the following conditions
1. Compliance with all provisions of the Town's Codes, ordinances and policies of the Northwest
Marana Area Plan and the General Plan, current at the time of any subsequent development,
including, but not limited to, requirements for public improvements.
2. A block plat is required for this project. This rezone is valid for three years from the date of
Town Council approval. If the developer fails to have the required block plat recorded prior to the
three years, then the property shall revert to the original zoning without further action by the Town
Council. The block plat shall include details of community design that address the requirements of
the Northwest Marana Area Plan.
3. A Development Agreement and phasing plan addressing infrastructure implementation is required
prior to the Planning Commission's review and recommendation of the required Block Plat. This
agreement shall address, at a minimum, the following:
a. Provision of the necessary sewer service
b. Improvements to accomplish a new railroad crossing at the Marana
interchange
c. The necessary off-site roadway improvements
d. Dedication, at the time of block platting, of the appropriate and necessary
roadway rights -of- -way in accordance with the Northwest Marana Area Plan
and Updated Master Transportation Plan requirements. Dedication of the
revised Cochie Canyon Road aligiunent through the site shall occur within
ninety (90) days of the rezoning approval.
e. Provision of appropriate financial contributions to regional transportation
improvements.
f. Provisions to address the necessary drainage improvements that take into
account off-site regional drainage patterns and impacts.
4. The applicant shall have five (5) years from Town Council approval to secure the necessary sewer
system to serve the proj ect site, as accepted by Pima County wastewater Management and the Town.
Engineer; if the developer fails to have the sewer in place prior to the five (5) years, then the property
shall revert to the original zoning without further action by the Town Council.
5. Potential buyers shall be notified of the existence and potential issues related to the operation of
the Union Pacific Railroad tracks, located southwest of the property. The Development Services
Marana, Arizona ordinance 2000.12 Page 2 of 6
Administrator, prior to review by the Plaiuiing Commission of the first Preliminary Plat, shall
approve the content and method of notification.
6. Potential buyers shall be notified of the existence and potential issues related to the operation of
the Cortaro - Marana Irrigation District located in the general vicinity of the property. The
Development Services Administrator, prior to review by the Planning Commission of the first
Preliminary Plat, shall approve the content and method of notification.
7. Realignment of Cochie Canyon Trail to match the existing Marana Interchange shall occur prior
to occupancy of dwelling units within the San Lucas project boundary. No platting shall occur prior
to approval by the Union Pacific Railroad of an acceptable crossing at this location. The costs of
constructing this connection, including installation of railroad crossing equipment, shall be borne
by this development.
8. The "VC" zoned property shall not be allowed to be developed at the "R -6" standards.
9. The area proposed to be zoned "CO" shall not be allowed to be developed at the "R -6" standards
unless buildings are existing on the property between the "CO" zoned property and the Railroad, as
accepted by the Development Services Administrator.
10. The Developer shall provide the necessary school site(s) in a size, quantity and location
acceptable to the Marana Unified School District and the Development Services Administrator
and subject to all Planning and Engineering standards, ordinances, etc., in effect at the time the
school is developed.
11. The Developer shall provide the necessary park sites), acceptable to the Parks and Recreation
Director and the Development Services Administrator, per the proposed Park, Trail, and Open Space
System Master Plan.

12. Prior to the required Block Plat the applicant shall prepare a treatment plan and perform the _N
necessary backhoe testing as recommended by the Arizona State Museum, dated November 29,
1999. This includes finalizing a burial agreement with the Arizona State Museum.
13. The developer shall submit lot dispersions with the Block Plat identifying the conceptual
dwelling assignments for each of the blocks in compliance with the Northwest Marana Area Plan.
14. one alternative route to serve the San Lucas project shall be established to serve as an
emergency access in the event of a blockage of the railroad crossing. This alternate access shall be
established prior to occupancy of dwelling units in the San Lucas project. This alternate access plan

will be provided and accepted by the Town and applicable emergency services providers (e.g. the
Fire District, ADOT, Department of Public Safety, etc.) as part of the subdivision platting process.
15. Prior to occupancy of any home, an all- weather, secondary vehicular access shall be available
to residents, visitors and emergency services providers to the satisfaction of the Development
Services Administrator and the Town Engineer.
16. Based upon the requirements of the Northwest Marana Area Plan, the maximum number of
dwelling units for the San Lucas Rezoning area is 839.
Section 3. • All ordinances, Resolutions, and Motions and parts of Ordinances, Resolutions, and
Motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby
repealed, effective as of the effective date of Ordinance No. 2000.12.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for
any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions hereof.
