Government Power
•Eminent Domain
•The inherent power of the government to take private property for
public use
•Limited by the 5th Amendment to the United States Constitution…
“nor shall private property be taken for public use,
without just compensation.”
Real Property Acquisition Process
•The public agency is required make a good faith attempt to purchase
the property prior to exercising eminent domain
•Establish just compensation based on an appraisal or market analysis
•Present an offer of just compensation
•Consider information and requests made by the owner
•If an agreement cannot be reached, the public agency may exercise its
power of eminent domain by initiating a condemnation court action
•The public agency is typically granted immediate possession of the
property
•Compensation to be paid to the owner is determined through the court
system, either through mediation, arbitration or by trial.
