HomeMy WebLinkAboutCouncil Presentation 04/05/2022 Real Property Acquisitions for Capital ProjectsReal Property Acquisitions for Capital Projects George Cardieri, Real Property Manager April 5, 2022 Government Power •Eminent Domain •The inherent power of the government to take private property for public use •Limited by the 5th Amendment to the United States Constitution… “nor shall private property be taken for public use, without just compensation.” Real Property Acquisition Process •The public agency is required make a good faith attempt to purchase the property prior to exercising eminent domain •Establish just compensation based on an appraisal or market analysis •Present an offer of just compensation •Consider information and requests made by the owner •If an agreement cannot be reached, the public agency may exercise its power of eminent domain by initiating a condemnation court action •The public agency is typically granted immediate possession of the property •Compensation to be paid to the owner is determined through the court system, either through mediation, arbitration or by trial. Current CIP Projects •Twin Peaks Rattlesnake Pass Improvements (ST073) •North Marana Sewer Interceptor Project (WR021) •East Tangerine Segment 1 Pipeline Upsizing (WT053) Twin Peaks Rattlesnake Pass Improvements •Project ST073 •Full Road Reconstruction •Added Travel Lanes, Turn Lanes, Center Medians, Multi-Use Pathways, New Landscaping and Drainage Improvements •Acquisitions funded by impact fees •DR Horton is contributing to the design and construction of the roadway North Marana Sewer Interceptor Project •Project WR021 •New 27” Sewer Main •Public Water and Sewer Easements will be acquired at this time •Acquisitions funded by wastewater capital fees East Tangerine Segment 1 Pipeline Upsizing •Project WT053 •New Water Main •Public Right of Way will be acquired at this time in preparation of the near future widening of Tangerine Road •Acquisitions funded by water impact fees
