A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA,
ARIZONA, ACCEPTING AND AUTHORIZING THE APPROVAL OF THE
INTERGOVERNMENTAL AGREEMENT (IGA) WITH THE CITY OF TUCSON FOR
GROUNDWATER MODELING ON THE SANTA CRUZ RIVER FOR THE TRES RIOS DEL
NORTE PROJECT.
WHEREAS, the City of Tucson and the Town of Marana are participating in the Tres Rios
del None project with Pima County and the United States Army Corps of Engineers; and
WHEREAS, the Tres Rios del None Project was adopted by Town of Marana's Mayor and
Council in September of 2001; and
WHEREAS, the City of Tucson and the Town of Marana will jointly contribute to the Tres
Rios del None Project by developing a groundwater flow model for that reach of the Santa Cruz
River that will establish baseline groundwater conditions; simulate effluent recharge; and the City
of Tucson and the Town of Marana hereby intend to apportion the costs of evaluating groundwater
in this study area through an Intergovernmental Agreement (IGA); and
WHEREAS, the City of Tucson awarded a contract to Errol L. Montgomery and
Associates to develop a groundwater flow model to evaluate effluent recharge in the Santa Cruz
River; and
WHEREAS, the City of Tucson has overseen the development of the groundwater flow
model pursuant to the terms of the Errol Montgomery Contract; and
WHEREAS, the City of Tucson has maintained a file containing all correspondence and
documents pertaining to the administration of the Errol Montgomery Contract and had made these
documents available to Town of Marana; and
WHEREAS, the share of the total contract cost allocated to the Tres Rios del Norte project
task is $126,237.00 and the fifty percent (50%) that Town of Marana shall be responsible for is
$63,118.00; and
WHEREAS, The Town of Marana shall reimburse the City of Tucson for fifty percent
(50 %) of the cost of tasks attributable to the Tres Rios del None Project by June 30, _00o;') "and

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, accepting and authorizing the approval of the Intergovernmental Agreement

CITY OF TUCSON - TOWN OF MARANA INTERGOVERNMENTAL
AGREEMENT RELATING TO GROUNDWATER MODELING OF RECHARGE
IN THE SANTA CRUZ RIVER
This is an Intergovernmental Agreement dated this /0 day Of,~ ILl, 2003,
by and between the City of Tucson, Arizona, a municipal corporation, ("Tucson"), and
the Town of Marana, Arizona, a town organized pursuant to A R S. 9 9-231 et seQ.,
("Marana").
SECTION I. RECITALS.
The following recitals represent the general principles to which the parties have
agreed. These principles are therefore incorporated in the specific covenants that
follow.
1.1 Tucson and Marana are empowered by ARS. Title 11, Chapter 1, Article
3 to enter into this Intergovernmental Agreement ("IGA").
1.2 Marana is authorized to own and operate a water utility and a sewer
system pursuant to ARS. 9 9-511 et seQ. and an election held pursuant
to ARS 99-514.
1.3 Marana owns and operates a water utility system serving a portion of the
area within Marana's incorporated limits.
1.4 Tucson is authorized by the Tucson Charter, Chapter IV, Section 1 (7)
"...to establish, maintain, equip, own and operate, works and appliances
within and without city for supplying the city and its inhabitants also
persons, firms and corporations outside Tucson, including other municipal
corporations, with water..."
1.5 The Tucson has awarded Contract No. 022012 for $234,785.00 to Errol L.
Montgomery and Associates to develop a groundwater flow model to
evaluate effluent recharge in the Santa Cruz River. ("The Errol
Montgomery Contract," Exhibit 1). The model has evaluated recharge of
four alternatives: (A) Effluent belonging to the Tucson, (8) All Effluent in
the Santa Cruz River, (C) Non-Tucson Effluent, and (D) Only Pima
County Effluent.

1.6 Tucson and Marana are participating in the "Tres Rios del Norte" project
with Pima County and the United States Army Corps of Engineers. The
project will assess potential environmental enhancements along a reach
of the Santa Cruz River between Prince Road and Sanders Road.
Tucson's and Marana's contribution to the Tres Rios del Norte Project is a
groundwater flow model for that reach of Santa Cruz River that
establishes baseline groundwater conditions and simulates effluent

recharge under alternatives B, C, and D of the Errol Montgomery
Contract.
1.7 The Tucson has assumed those costs associated with the evaluation of
Alternative A (Tucson's effluent).
1.8 Except for the Alternate A Costs described in paragraph 2.5, Tucson and
Marana intend to pay for the remaining costs of the Errol L. Montgomery
and Associates recharge study for the Tres Rios del Norte-related tasks,
which are apportioned fifty percent (50%) to Tucson and fifty percent
(50%) to Marana.
NOW, THEREFORE, in consideration of the mutual promises and covenants
contained herein, the parties covenant and agree as follows:
SECTION II. PROVISIONS APPLICABLE TO TUCSON.
2.1 Tucson has overseen the development of the groundwater flow model
pursuant to the terms of the Errol Montgomery Contract. (Exhibit 1).
2.2 Tucson has invited Marana staff to attend all meetings between Tucson staff
and Errol Montgomery staff.
2.3 Tucson has maintained a file containing all correspondence and documents
pertaining to its administration of the Errol Montgomery Contract, which
documents shall be available to Marana for copying at any time during its
oversight, and for a period of two (2) years following the completion of the
contract tasks. Correspondence and documents between legal counsel for
either Tucson or Marana and any party shall be maintained separately and
treated as privileged and confidential.
2.4 Tucson has paid the invoices submitted pursuant to Section III of the Errol
Montgomery Contract. Tucson will send copies of original invoices and other
billing information to the Marana, as specified below in Section 4.5, invoices
paid to date are Attached as Exhibit 2).

2.5 The Tucson has been responsible for the following tasks, as outlined in the
Errol Montgomery Contract:

2.6 Tucson's Payments to Date. Tucson has paid to date one hundred percent
(100%) of the cost of Tasks 3.2.1, 4.1, and 5, and has also paid for the

remaining Tres Rios del Norte costs, as allocated below in Sections 3.1 and
3.2.2.
2.7 Work product resulting from Alternative A of the Errol Montgomery Contract,
including data and reports, shall be the exclusive property of Tucson. All
other work product resulting from the Errol Montgomery Contract shall be
the property of both Tucson and Marana. Tucson and Marana shall receive
disk copies of all data, as well as copies of all reports.
SECTION III. PROVISIONS APPLICABLE TO MARANA.
3.1 Shared Costs. Except for exclusion of U Alternative A" work costs, Marana
shall reimburse Tucson for fifty percent (50%) of the cost of the following
enumerated tasks attributable to the Tres Rios del Norte project. The
tasks attributable to the Tres Rios del Norte project, as outlined in the
Errol Montgomery Contract, and paid by the Tucson which are to be
shared, with Marana, are:

3.2 Tres Rios del Norte Partners Cost Share. The share of the Total Contract
cost allocated to the Tres Rios del Norte project tasks is $126,237.
Tucson shall be responsible for fifty percent (50%) of these costs
($63,118.00) and Marana shall be responsible for the other fifty percent
(50%) of the Tres Rios del Norte project costs ($63,118.00).

3.3 Marana will pay Tucson for its fifty percent (50%) share of the itemized
invoices, attached as Exhibit 2 to this Agreement, by July 1, 2003.

3.4 With the exception of work product resulting from Alternative 1, all other
work product resulting from the Errol Montgomery Contract shall be the
property of both Tucson and Marana. Tucson and Marana shall receive
disk copies of all data, as well as copies of all reports.

SECTION IV. MISCELLANEOUS PROVISIONS.
4.1 Force Maieure: In the event any party is rendered unable, wholly or in
part, by force majeure reasons to carry out its obligations under this
Agreement, the obligations of both the other parties so far as they are
affected by such force majeure shall be suspended during the
continuance of any inability so caused, but for no longer period; and such
cause shall be so far as possible remedied with the best efforts of the
disabled party and with all reasonable dispatch. The term "force majeure"
as employed in this Agreement shall mean acts of God, strikes, lockouts
or other industrial or labor disturbances, acts of the public enemy, wars,
blockades, insurrections, riots, epidemics, land slides, lightning,
earthquakes, fires, storms, floods, washouts, droughts, unavoidable
interruptions in electric power to drive pumps, interruptions by
government not due to the fault of parties, including injunctions, civil
disturbances, explosions, well collapses, breakage or accident to
machinery or transmission facilities, or action or non-action by
governmental bodies in approving or failing to act upon applications for
approvals or permits which are not due to the negligence or willful action
of the parties. Nothing herein contained shall be construed as requiring
any party to settle a strike or labor dispute against its will. Nothing herein
shall prohibit any party at its own expense from using whatever self-help
remedies may be available to it.
4.2 Default: In the event of default by any party for failure to perform pursuant
to the terms of this Agreement, the non-defaulting parties shall notify the
defaulting party of the default. Said notice( s) shall be in writing and shall
state the facts constituting default, including the date and time (if
possible) such default is deemed to have occurred, and shall further set
forth what action is necessary in the non-defaulting parties' opinion to
cure the default. If the non-defaulting parties deem no cure possible, the
notice(s) shall so state. The defaulting party shall have a reasonable time
from notice to cure the default. In the event the default is not cured within
such time, the parties shall meet at least once to attempt to resolve said
differences. It is agreed that at the time when the parties are attempting to
resolve their differences with respect to an alleged default, the parties
shall continue to fulfill their obligations pursuant to the balance of the
provisions of this Agreement and such continuance shall not in any way
waive the default. If, at the end of sixty (60) days from the date of notice of
default, the parties are unable to resolve their differences, then the
parties shall have all rights and remedies available to them under law
including specific performance.

4.3 Attorney's Fees: In the event of any litigation between the parties to
enforce any provision of this Agreement or any right of either party hereto,
the unsuccessful party to such litigation agrees to pay to the successful
party all reasonable costs and expenses, including reasonable attorney's

fees, incurred therein by the successful party, all of which shall be
included in and as part of the judgment rendered in such litigation.
4.4 Assianment of Aareement: No party shall have the right to assign this
Agreement nor any interest herein except to their respective successors.
4.5 Notices: All notices shall be in writing and together with other mailings
pertaining to this Agreement shall be made to:

4.6 Waiver: Waiver by any party of any breach of any term, covenant or
condition herein contained shall not be deemed a waiver of any other
term, covenant or condition, or any subsequent breach of the same or any
other term, covenant, or condition herein contained.

4.7 Amendment: This Agreement shall not be amended except by written
instrument mutually agreed upon and executed by the parties.

4.8 Entire Aqreement: This Agreement, its Exhibits and its recitals which are
included herein, constitute the entire agreement between the parties, and
includes all prior oral and written agreements of the parties. All warranties
and guarantees and representations shall survive during the life of this
Agreement.
4.9 Construction and Interpretation: All provisions of this Agreement shall be
construed to be consistent with the intention of the Parties expressed in
the recitals hereof.
4.10 Time of the Essence: Time is of the essence in the exercise of all rights
and the discharge of all responsibilities and obligations by each of the
parties hereto."
4.11 Authority: Each of the undersigned parties represents and warrants that it
has legal authority and capacity to enter into this Agreement upon the
terms and conditions provided within this Agreement, and has properly
and legally authorized and executed this Agreement.
4.12 Leqal Jurisdiction: Nothing in this Agreement shall be considered as either
limiting or extending the legal jurisdiction of either Marana or Tucson.
4.13 Severability: In the event that any provision of this Agreement or the
application thereof is held invalid, such invalidity shall have no effect on
other provisions and their application which can be given effect without
the invalid provision, or application, and to this extent the provisions of the
Agreement are severable.
IN WITNESS WHEREOF, the Parties hereto have hereunto set their hands the
day and year first above written.

I. INTRODUCTION
This Contract is being issued pursuant to City Of Tucson RFQ 022012 for Professional
Design Services the Groundwater Flow Model to Evaluate Effluent Recharge in the Santa Cruz
River. Services rendered under this contract are detailed in Exhibit 1 Scope of Professional
Services.
II.
TIME OF PERFORMANCE
r
1. All services detailed in Exhibit 1 Scope of Professional Services shall be completed pursuant
to the Project Schedule detailed in Exhibit 3.
2. Five copies of the draft report for Alternative A will be submitted by May 20, 2002. After
comments are received from Tucson Water, a final report will be prepared. Ten copies of the
final.report, in paper and electronic formats, will be submitted by July J 5, 2002, along with
input files for the groundwater flow and particle tracking models.
3. , Nine copies of the draft report for Alternatives B-D Report A will be submitted by May 1,
2002. After comments are received, a letter responding to comments will be prepared and
submitted by May 27, 2002. Nine copies of an updated report will then be prepared and
submitted by June 14,2002. After comments are received, a letter responding to comments
will be prepared and submitted by July 26, 2002. Nine copies of the final report, in paper and
electronic formats, will be submitted by August 15, 2002, along with input files for the
groundwater flow model.
4. Nine copies of the draft report and user's manual for Alternatives A-D Report B will be
submitted by October 1, 2002. After comments are received, nine copies of a final report and
user's manual, in paper and electronic formats, will then be prepared and submitted by
November 13, 2002, along with input files for the groundwater flow model.
III.
FINANCIAL CONSIDERATIONS
1. In consideration of the services described in Exhibit 1, the City shall pay the consultant an
amount not to exceed $230,285. The City shall only pay the Consultant in accon;lance with the
negotiated contract rates detailed in Exhibit 2, arid the Consultant shall charge the City only in
accordance with those same rates. This amount shall not be exceeded unless there is a
change in scope and without prior written notice from the City of Tucson in the form of a contract
amendment.
2. The City will pay the Consultant following the submission of itemizedinvoice(s). Each
itemized invoice must bear a written certification by an authorized. City representative
confirming the services fOJ which payment is requested.
3. The invoice shall be submitted month'ly based upon percentage of work complete and shall
include a ten percent (10%) retainage of the amount billed for completed work. Upon
completion of the project to the satisfaction of the City and acceptance of the work, final
payment and release of retention shall be made.
4. Direct expenses shall be paid at cost to consultant and shall include no markup.

IV. SPECIAL TERMS AND CONDITIONS
1. SOFTWARE COMPATABILlTY: For the purposes of aiding the Consultant in the
performance of their obligation under this Contract, the City shall furnish upon request all
relevant data in the City's possession and shall direct City officers, agents and employees to
render all reasonable assistance to Consultant in connection with Consultants performance
under this Contract. The provision of such aid, assistance, information or services as
received from the City shall in no way relieve the Consultant from obligations under this
Contract. The City does not warrant the compatibility of City furnished data, either electronic
or in any form, with the Consultant's software. All costs associated with data conversion or
software upgrades and conversions shall be borne by the Consultant.

3) Deductibles will be stated on the certificate of insurance and are subject to the review and
approval of the City.
4) Professional liability insurance limits will be increased for projects or contracts based
upon the degree of risk to which the City is exposed.
5) Professional liability insurance carried by the consultant must cover all elements of the
project including professional services performed by subcontractors. If the consultant's
professional liability insurance does not provide coverage for work performed by
subcontractors, separate project insurance will be required to comply with the
professional liability insurance requirement. The City may require a copy of the
professional liability insurance policy to verify coverage.
3. KEY PERSONNEL: It is essential that the Consultant provide adequate experienced
personnel, capable of and devoted to the successful accomplishment of work to be
performed under this Contract. The Consultant agrees to assign specific individuals to the
key positions.
1) The Consultant agrees that once assigned to work under this Contract, key
personnel shall not be removed or replaced without written notice to the City.

2) If key personnel are not available for work under this Contract for a continuous
period exceeding five (5) calendar days, or are expected to devote substantially
less effort to the work than initially anticipated, the Consultant shall immediately
notify the City, and shall, subject to the concurrence of the City, replace such
personnel with personnel of substantially equal ability and qualifications.
4.
OTHER CONTRACTS: The City may, as its sole option, enter into Contracts for
additional work related to this project. The Consultant shall fully cooperate with other
contractors and consultants and with City employees to accommodate such other work. The
Consultant shall not commit or permit any act that interferes with the performance of such
work by other contractors.

c) Consultant or Firm - Used interchangeably in referring to the architect, engineer,
landscape architect, or land surveyor organization offering professional services

d) Evaluation Committee - The committee established to formally evaluate
proposals according to the evaluation criteria listed herein.
e) Joint Venture - Two or more persons or entities combining their property,
money, skills, and knowledge to form a distinct legal entity to carry out a single
business enterprise for profit, pursuant to a written agreement.
f) Contract - The legal agreement executed between the City of Tucson, AZ and the
Consultant'Firm.

g) City Project Manager - The City employee specifically designated as responsible
for monitoring and overseeing the Consultant's performance under this Contract.
Also referred to as City Designated Contract Representative.
h) Director of Procurement - The contracting authority for the City of Tucson, AZ,
authorized to sign contracts and amendments thereto on behalf of the City of
Tucson, AZ.
2. NOTICE TO PROCEED: The Consultant agrees to render professional services
promptly and diligently upon receipt of written notice to proceed with any or all of the
services set forth herein.
3. RECORDS: Internal control over all financial transactions related to this Contract
shall be in accordance with sound fiscal policies. The City may, at reasonable times
and places, audit the books and records of Consultant or any and all of Consultant's
sub-consultants. Said audit shall be limited to this Contract and its scope of services.

4. PRINCIPAL CONSULTANT'S RESPONSIBILITY: The Consultant shall be
responsible for the professional quality, technical accuracy, and the coordination of all
designs, drawings, specifications, and other services furnished by the Consultant
under this Contract. The Consultant shall without additional compensation, correct or
revise any errors or deficiencies in its designs, drawings, specifications, and other
services. Additionally, when modification to a construction contract is required
because of an error or deficiency in the services provided under this architectural-

be reasonably liable.

Neither the City's review, approval or acceptance of, nor payment for, the services
required under this Contract shall be construed to operate as a waiver of any rights
under this Contract or of any cause of action arising out of the performance of this
Contract, and the Consultant shall be and remain liable to the City in accordance with
applicable law for all damages to the City caused by the Consultant's negligent
performance of any of the services furnished under this Contract.
If the Consultant is comprised of more than one legal entity, each such entity shall be
jointly and severally liable hereunder.
The Consultant agrees that the work to be performed pursuant to this agreement
shall be under the. full authority and responsible charge of the undersigned principal
of the firm or officer of the corporation who must be the holder of a current Arizona
Certificate of Registration issued by the Board of Technical Registration for the
practice of architectural and/or engineering in the State of Arizona.

Any drawings, plans, specifications, and estimates to be prepared pursuant to this
agreement shall be prepared by or under the personal direction of the undersigned
qualified holder of an Arizona Certificate of Registration issued by the Arizona Board
of Technical Registration.
The Consultant shall be responsible for the completeness and accuracy of all
services rendered and correction of all errors of omission or commission on the
drawings, specifications, and other documents notwithstanding prior approval by the
City.
By signing the Contract, the Consultant affirms that it has the ordinary skill,
knowledge, and judgement possessed by members of its profession, and that it
will use reasonable and ordinary care and diligence in performing the work.
5. ADDITIONAL COMPENSATION
The Consultant shall submit a written proposal and secure the City Director of
Procurement's written approval of same prior to the performance by the Consultant of
any work for which additional compensation will be requested.

other deliverables, which may be created under this Contract, are the sole property of
the City of Tucson. Property of the City shall not be used or released by the
Consultant or any other person except with prior written permission by the City.

7. DRAWING, STANDARD DETAILS, ETC.: City of Tucson drafting standards,
standard details, specifications, and office procedures are to be used in the
preparation of items required under this Contract unless directed otherwise by the
City. The City will furnish the Consultant with copies of the necessary standard City
documents. All final documents shall be prepared by such methods and of such
quality of workmanship as will permit the making of satisfactory reproductions.
8. ADVICE AND CONSULTATION: The Consultant shall be available to the City for
advice and consultation on the interpretation of the plans and specifications on
questions, which may arise during the course of this Contract.
9. PUBLIC HEARINGS: The Consultant shall upon request, attend any public hearing
on matters related to the scope of professional services set forth in this Contract.
10. TIME RECORDS: The Consultant shall maintain complete, current and daily records
covering all hours actually worked on this project by the various classes of workers.
The City shall have the right to audit and/or examine such records at any time during
the progress of this Contract and shall withhold payment if such documentation is
~ found by the City to be incomplete or erroneous.
11. PROTEST PROCEDURE: Should a firm believe that the City has not properly
followed the selection procedures as outlined in Administrative Directive 3.06-02, the
firm may file a protest as described in the Administrative Directive 3.06-2.
A protest shall be in writing and shall be filed with the Director of Procurement. A
protest of a Request for Qualification and/or Request for Proposal shall be received
at the Department of Procurement before the solicitation opening date. A protest of a
proposed award or of an award shall be filed within ten days after the protestor knows
or should have known the basis of the protest. A protest shall include:
a) The name, address, and telephone number of the protestor;
b) The signature of the protestor or its representative;
c) Identification of the solicitation number;
d) A detailed statement of the legal and factual grounds of protest including copies of
relevant documents; and, '.
e) The form of relief requested.

b) The Consultant shall not discriminate against any employee or applicant for
employment in violation of Federal Executive Order 11246.
c) The Consultant has not given, offered to give, nor intends to give at any time
hereafter, any economic opportunity, future employment, gift, loan, gratuity,
special discount, trip, favor, or service to a public servant in connection with the
submitted offer.
d) Consultant certifies by signing that if a design is required for this project, the
design being furnished will contain no specifications for tropical hardwood
excluded from consideration of purchase by the City of Tucson. A list of tropical
hardwood may be obtained from the City's Department of Procurement.
Consultants knowingly violating the tropical hardwood restriction may be barred
from any further contracting with the City of Tucson.
e) The Consultant submitting the offer hereby certifies that the individual signing the
offer is an authorized agent for the Consultant and has the authority to bind the
Consultant to the Contract.

13. TERMINATION OF CONTRACT:
a) The City may terminate this Contract in whole or, from time to time, in part, for the
City's convenience or because of the failure of the Consultant to fulfill the Contract
obligations. Upon receipt of the notice of termination, the Consultant shall 1)
immediately discontinue all services affected (unless the notice directs otherwise),
and 2) deliver to the Department of Procurement all data, drawings, specifications,
reports, estimates, summaries, and other information and materials accumulated
in performing this Contract, whether completed or in process.
b) If the termination is for the convenience of the City, the City shall make an
equitable adjustment in the contract price but shall allow no anticipated profit on
unperformed services.
c) If the termination is for failure of the Consultant to fulfill the contract obligations,
the City may complete the work by contract or otherwise, and the Consultant shall
be liable for any additional cost incurred by the City.
d) If, after termination for failure to fulfill contract obligations, it is determined that the
Consultant has not failed, the rights and obligations of the parties shall be the
same as if the termination had been issued for the convenience of the City.

e) The rights and remedies of the City provided in this clause are in addition to any
other rights or remedies provided by law or under this Contract.

14. SUSPENSION OF WORK:
a) The City may order the Consultant, in writing, to suspend, delay, or interrupt all or
any part of the work under this Contract for the period of time that the City
determines appropriate for the convenience of the City.
b) The Consultant agrees that no charges or claims for damages shall be made
against the City for any delays or hindrances during the progress of this Contract.
Such delays or hindrances, if any will be covered by an extension of time for such
reasonable period as mutually agreed upon between the parties. It is agreed and
understood, however, that permission to proceed with the Contract after the
established completion date shall not be construed as a waiver by the City of any
of the rights herein.
15.ARBITRATION: It is understood and agreed that no provIsion of the Contract
relating to arbitration or requiring arbitration shall apply to or be binding upon the City
except by the City's express written consent given subsequent to the execution of the
Contract. However, if both parties agree, disputes may be resolved through
arbitration. The dispute shall be resolved as provided for in A. R.S. Sec. 12-1501, et
seq. Consultant shall continue to render the services required by this Contract
without interruption, notwithstanding the provisions of this section.

16.INDEPENDENT CONSULTANT: It is clearly understood that each party shall act in
its individual capacity and not as an agent, employee, partner, joint venturer, or
associate of the other. An employee or agent of one party shall not be deemed or
construed to be the employee or agent of the other party for any purpose whatsoever.
Consultant shall not be entitled to compensation in the form of salaries, or to paid
vacation or sick days by the City, and that such days do not accumulate for the use of
same at a later date.
The City of Tucson will not provide any insurance coverage to Consultant, including
Worker's Compensation coverage. The Consultant is advised that taxes or social
security payments shall not be withheld from a City payment issued hereunder and
that Consultant should make arrangements to directly pay such expenses, if any.

17. HUMAN RELATIONS: Consultant agrees to abide by the provisions of the Tucson
Code Chapter 28, Article XII, Section 28-138, Provision against discrimination
required in all City contracts.
18. NON-EXCLUSIVE CONTRACT: Any contract resulting from this solicitation shall be
awarded with the understanding and agreement that it is for the sole convenience of
the City of Tucson. The City reserves the right to obtain like goods or services from
another source when necessary.

1"". 19. DUPLEXED/RECYCLED PAPER: In accordance with efficient resource procurement
and utilization policies adopted by the City of Tucson, the Consultant shall ensure
that, whenever practicable, all printed materials produced by the Consultant in the
performance of this Contract are. duplexed (two-sided copies), printed on recycled
paper and labeled as such.
20. PATENT INFRINGEMENT: The procuring agency should advise the Consultant of
any impending patent suit and provide all information available. The Consultant shall
defend any suit or proceeding brought against the procurement agency based on a
claim that any equipment, or any part thereof, furnished under this Contract
constitutes an infringement of any patent, and the Consultant shall pay all damages
and costs awarded therein, excluding incidental and consequential damages, against
the procuring agency. In case said equipment, or any part thereof, is in such suit
held to constitute infringement and use of said equipment or part in enjoined, the
Consultant shall, at its own expense and at its option, either procure for the procuring
agency the right to continue using said equipment or part, or replace same with
noninfringing equipment, or modify it so it becomes non-infringing.

21.AFFIRMATIVE ACTION: Contractor agrees to abide by the provisions of the Tucson
Code Chapter 28, Article XII Sections 28-137 to 28-144, Affirmative Action by City
Contractors. Contractor, your subcontractor(s) and supplier(s) agree to adhere to a
policy of equal employment opportunity and demonstrate an affirmative effort to
recruit, hire, promote and upgrade the position of employees regardless of race,
color, religion, ancestry, sex, age, disability, national origin, sexual orientation, gender
identity, familial status, or marital status and who agree and are responsive to the
City's goals.
Specifically, the Contractor agrees to submit the following reports to the City's Equal
Opportunity Office before contract award:
a) A copy of their Federal EEO-1 Report, if Contractor was ever required to file one
with the Federal Government;
b) A completed City of Tucson Affirmative Action Questionnaire;
c) An Affirmative Action Plan.
All such reports on file with the Equal Employment Opportunity Office will be updated
at least annually. The Equal Employment Opportunity Office may for good cause
recommend to the City's Director of Procurement that failure to comply with the
requirements of this subsection be waived and that the bid be accepted contingent
upon receipt of the required reports before a notice to proceed is issued.

23. CONFIDENTIALITY OF RECORDS: The Consultant shall establish and maintain
procedures and controls that are acceptable to the City for the purpose of assuring
that no information contained in its records or obtained from the City or from others in
carrying out its functions under the Contract shall be used by or disclosed by it, its
agents, officers, or employees, except as required to efficiently perform duties under
the Contract. Persons requesting such information should be referred to the City.
Consultant also agrees that any information pertaining to individual persons shall not
be divulged other than to employees or officers of Consultant as needed for the
performance of duties under the Contract, unless otherwise agreed to in writing by
the City.
24.GRATUITIES: The City may, by written notice to the Consultant, cancel this Contract
if it is found that gratuities, in the form of entertainment, gifts or otherwise, were
offered or given by the Consultant or any agent or representative of the Consultant, to
any officer or empl.oyee of the City amending. In the event this Contract is canceled
by the City pursuant to this provision, the City shall be entitled, in addition to any
other rights and remedies, to recover or withhold from the Consultant the amount of
the gratuity.

25.APPLlCABLE LAW: This Contract shall be governed by the law of the State of
Arizona, and suits pertaining to this Contract shall be brought only in Federal or State
courts in the State of Arizona.
26. CONTRACT: The Final Contract document shall be written and shall be based upon
the Request for Qualifications and/or the Request for Proposal issued by the City, the
offer submitted by the Consultant in response to the Request for Qualifications and/or
the Request for Proposal, and any negotiations entered into and changes agreed
upon by both parties. The offer shall substantially conform to the terms, conditions,
specifications and other requirements set forth within the text of th~ Request for
Qualifications and/or the Request for Proposal. The City reserves the right to clarify
any contractual terms with the concurrence of the Consultant; however, any
substantial non-conformity in the offer, as determined by the City's Director of
Procurement, shall be deemed non-responsive and the offer rejected. The Contract
shall contain the entire agreement between the City of Tucson and the Consultant
relating to this requirement and shall prevail over any and all previous agreements;
contracts, proposals, negotiations, purchase orders, or master agreements in any
form.

27. LEGAL REMEDIES: All claims and controversies shall be subject to the Tucson City
Charter and Code.

PROVISIONS REQUIRED BY LAW: Each and every provision of law and any clause
required by law to be in the Contract shall be read and enforced as though it were
included herein, and if through mistake or otherwise any such provision is not.
inserted, or is not correctly inserted, then upon the application of either party the
Contract shall forthwith be physically amended to make such insertion or correction.

30. SEVERABILITY: The provisions of this Contract are severable to the extent that any
provision or application held to be invalid shall not affect any other provision or
application of the Contract which may remain in effect without the valid provision or
applicatiori.
31. INTERPRETATION - PAROL EVIDENCE: This Contract is intended by the parties
as a final expression of their agreement and is intended also as a complete and
exclusive statement of the terms of this agreement. No course of prior dealings
between the parties and no usage of the trade shall be relevant to supplement or
explain any term used in this Contract. Acceptance or acquiescence in a course of
performance rendered under this Contract shall not be relevant to determine the
meaning of this Contract even though the accepting or acquiescing party has
knowledge of the nature of the performance and opportunity to object.
32. ASSIGNMENT - DELEGATION: No right or interest in this Contract shall be
assignable in whole or in part without the written consent of the parties hereto, and no
V' delegation of any duty of Consultant shall be made without prior written permission of
the City's Procurement Director. This Contract and all of the terms, conditions and
provisions herein, shall extend to and be binding upon the heirs, administrators,
executors, successors, and assigns of the parties hereto. The City shall not
unreasonably withhold approval of assignment/delegation and shall notify the
Consultant of the City's position within 15 days of receipt of written notice by the
Consultant.
33. SUBCONTRACTS: No subcontract shall be entered into by the Consultant with any
other party to furnish any of the material/service specified herein without the advance
written approval of the City's Procurement Director. All subcontracts shall comply
with Federal and State laws and regulations which are applicable to the services
covered by the subcontract and shall include all the terms and conditions set forth
herein which shall apply with equal force to the subcontract, as if the sub-consultant
were the Consultant referred to herein. The Consultant is responsible for contract
performance whether or not sub-consultants are used. The City shall not
unreasonably withhold approval and shall notify the Consultant of the City's position
within 15 days of receipt of written notice by the Consultant.

35. ACKNOWLEDGMENTS: Consultant acknowledges that all material or service
delivered under this Contract shall conform to the specifications of this Contract.
Mere receipt of shipment of the material or service specified and any inspection
incidental thereto by the City shall not alter or affect the obligations of the Consultant
or the rights of the City under the foregoing warranties. Additional warranty
requirements may be set forth in this document.

36. INDEMNIFICATION: Consultant shall indemnify, defend, and hold harmless the City,
its Mayor and Council, appointed boards and commissions, officials, officers, and
employees and insurance carriers, individually and collectively from any and all
claims, demands, suits, actions, proceedings, loss, cost, subrogation's, and damages
of every kind and description, attorney's fees and/or actions of any kind, which may
be brought or made against or of any person, resulting from personal injury to any
person (including bodily injury and death) or damages to any property, arising or
alleged to have arisen out of either: (1) the Consultant's negligent performance of the
terms of this Contract, or, (2) any of the Consultant's negligent acts or omissions.
The Consultant's obligation under this section shall not extend to any liability caused
by the sole negligence of the City or its employees. The amount and type of
insurance coverage requirements set forth herein will in no way be construed as
limiting the scope of indemnity in this paragraph.
37. OVERCHARGES BY ANTITRUST VIOLATIONS: The City maintains that, in actual
practice, overcharges resulting from antitrust violations are borne by the purchaser.
Therefore, to the extent permitted by law, the Consultant hereby assigns to the City
any and all claims for such overcharges as to the materials or services used to fulfill
the Contract.
38. RIGHT TO ASSURANCE: Whenever one party to this Contract in good faith has
reason to question the other party's intent to perform, the former party may demand
that the other party give a written assurance of this intent to perform. In the event
that a demand is made and no written assurance is given within five (5) days, the
demanding party may treat this failure as an anticipatory repudiation with this
Contract.

40. RIGHT TO INSPECT: The City may, at reasonable times, and at the City's expense,
inspect the place of a Consultant or sub-consultant which is related to the
performance of any contract as awarded or to be awarded.

WORK SCHEDULE: The Consultant shall adhere to any and all work schedules
developed under this contract. The work schedule will provide for the completion of
services within a specified number of consecutive calendar days following the starting
date established by a written notice to proceed. If the Consultant is unable to adhere
to the accepted schedule, they shall prepare a justification letter with a proposed
revised schedule and submit the same to the City for review and approval. It shall be
the sole option of the City to approve any such requests. The City shall be furnished
two (2) copies of the original work schedule and two (2) copies after each revision, if
any, is approved.

42. FORCE MAJEURE:
Except for payment of sums due, neither party shall be liable to the other nor deemed
in default under this Contract if and to the extent that such party's performance of this
Contract is prevented by reason of Force Majeure. The term "Force Majeure" means
a major occurrence that is beyond the control of the party affected and occurs without
its fault or negligence. Force Majeure shall not include late performance by a sub-
consultant unless the delay arises out of a Force Majeure occurrence in accordance
with this Force Majeure term and condition.
If either party is delayed at any time in the progress of the work by Force Majeure, the
delayed party shall immediately notify the other party in writing of such delay of the
commencement thereof, and shall specify the causes of such delay in such notice.
Such notice shall be hand-delivered or mailed certified-return receipt and shall make
a specific reference to this article, thereby invoking its provisions. The delayed party
shall cause such delay to cease as soon as practicable and shall notify the other
party in writing when it has done so. The time of completion shall be extended by
contract modification for a period of time equal to the time that results or effects of
such delay prevent the delayed party from performing in accordance with this
Contract.
43. INSPECTION: All material or service is subject to final inspection and acceptance by
the City. Material or service failing to conform to the specifications of this Contract
shall be held at Consultant's risk and may be returned to the Consultant. If so
returned, all costs are the responsibility of the Consultant. Noncompliance shall
conform to the cancellation clause set forth in this docl,lment.
44. PAYMENT: A separate invoice shall be issued for each shipment of material or
service performed, and no payment shall be issued prior to receipt of material or
service and correct invoice.
The City shall make every effort to process paynlent for the purchase of materials or
services within twenty-one (21) calendar days after receipt of materials or services
and a correct invoice.

45. BUSINESS LICENSES AND PERMITS: Consultant shall maintain in current status
all Federal, State, and local registrations, licenses and permits required for the
operation of the business conducted by the Consultant as applicable to this Contract.

the property of the City and shall become a matter of public record available for
review subsequent to the award notification.

49. SUBSEQUENT EMPLOYMENT: The City may cancel this Contract without penalty
or further obligation pursuant to AR.S. Section 38-511 if any person significantly
involved in initiating, negotiating, securing, drafting, or creating the Contract, on
behalf of the City is or becomes, at any time while the Contract or any extension of
the Contract is in effect, an employee of, or a Consultant to any other party to this
Contract with respect to the subject matter of the Contract. Such cancellation shall be
effective when written notice from the Director of Procurement is received by the
parties to this Contract, unless the notice specifies a later time.
50. MINORITY/wOMAN BUSINESS ENTERPRISE: Consultant agrees to give
Minority/Woman Businesses the maximum practical opportunity to participate in this
Contract when possible, by obtaining supplies, materials, and services from such
firms. 1

51. PROJECT COMPLIANCE: At a minimum, the project shall be designed to comply
with all applicable Federal, State and Local regulations and any amendments thereto
which are adopted during the life of this Contract. Therefore, the Consultant should
be aware that any of the following may apply to this project. Compliance with these is
required and it shall be the responsibility of the Consultant to alert the City of any
deviation from this requirement. (Note: It is the Consultant's sole responsibility to

In accordance with a request from Tucson Water Department, Errol L.
Montgomery & Associates, Inc., has prepared the following scope of work, schedule,
and estimated costs for profession~1 services for groundwater flow modeling to
evaluate effluent recharge in the Santa Cruz River. The scope of work has been
prepared based on: 1) information contained in the Request for Qualifications
No. 022012 and Amendment No.1; 2) additional information obtained during a
meeting with Tucson Water staff on December 27, 2001, and subsequent
discussions with Tucson Water staff; 3) knowledge of hydrogeologic conditions in
the region and previous experience with technical feasibility investigations and
groundwater flow modeling for the Avra Valley Recharge Project and the Lower
Santa Cruz Replenishment Project; and 4) knowledge of the Arizona Department of
Water Resources (ADWR) groundwater flow models for the Tucson Active
Management Area (AMA) and the U.S. Geological Survey (USGS) models for the
Avra Valley and upper Santa Cruz subbasins.

The principal objectives of the groundwater flow modeling investigation are to:
1) develop groundwater flow and particle tracking models and project future
hydrologic conditions, as required to support application(s) to ADWR for Managed
Underground Storage Facility (MUSF) permit(s) that allow for storage of the
maximum volume of effluent that is anticipated to be available through year 2025,
along the reach of the Santa Cruz River from Roger Road Treatment Plant (RRTP)

model users manual suitable for use by the U.S. Corps of Engineers (USCOE) and
the Tres Rios del Norte (TRDN) project cooperators to evaluate alternatives for

Road. Groundwater flow modeling of effluent recharge will be conducted and
documented for four alternatives:

TASK 1: REVIEW OF HYDROLOGIC DATA AND ADWR MODEL
The purpose of TASK 1 is to compile and review information that will be
required to meet project objectives. Principal sources of information will include
ADWR, Tucson Water, USGS, Town of Marana, and Cortaro-Marana Irrigation
District (CMID). For estimating costs, the assumption was made that Tucson Water
will provide the following to Montgomery & Associates:
1. Input and output files for ADWR calibrated groundwater flow
model.
2. ADWR spreadsheets containing pumping data used to prepare
input files for groundwater model.
3. Effluent volumes to be released into the stream channel through
year 2025 and effluent ownership information.

4.
Pumping data and groundwater level measurements for Tucson
Water wells within 10 miles of Santa Cruz River downstream
from RRTP.
5. All available stream gage data for Santa Cruz River downstream
from RRTP.
6. Locations of landfills for which Montgomery & Associates will
prepare hydrographs of projected water level rise (TASKS 4.1
and 5). .

Model input files will be reviewed to verify appropriate assignment of historic
and future effluent recharge volumes, pumping rates for wells, and aquifer hydraulic
parameters within 5 miles of the Santa Cruz River. Pumping data from the ADWR
spreadsheet provided by Tucson Water will be summarized in tables, maps, and
graphs for wells located within 10 miles of the subject reach of the Santa Cruz River.
Projected effluent volumes to be released to the Santa Cruz River will be used to
compute effluent recharge volumes by subtracting evapotranspiration losses
estimated by USGS. Average annual natural recharge estimated by USGS and/or

ADWR will be added to projected effluent recharge volumes to project total recharge
volumes. Projected total recharge volumes will then be compared to recharge
volumes specified in the ADWR calibrated groundwater flow model and results of
comparisons will be documented.
Montgomery & Associates will request and compile the following data:
1. Groundwater level measurements for non-City wells located within
10 miles of the subject reach of the Santa Cruz River from RRTP to
Baumgartner Road.
2. Well construction records for wells located within about 2 miles
from the subject reach of the Santa Cruz River.
Groundwater level measurements for non-City wells will be obtained from the
Town of Marana, CMID, Metropolitan Domestic Water Improvement District, and the
ADWR Groundwater Site Inventory database. Well construction records will be
compiled from previous reports and from the ADWR "55" well registry and
Groundwater Site Inventory databases.
A groundwater level altitude contour map will be prepared for the most recent
comprehensive set of groundwater level measurements available ,for wells located
within 10 miles of the subject reach of the Santa Cruz River. Water level hydro-
graphs will be prepared and water level response for wells near the Santa Cruz
River will be compared to response for wells distant from the river to characterize
differences in groundwater level responses to historic effluent recharge. The water
level hydrographs will also be used during TASK 2 for comparison to water levels
projected using the ADWR calibrated groundwater flow model.

TASK 2: PRELIMINARY GROUNDWATER MODELING
The objective of TASK 2 is to conduct preliminary projections of groundwater
level using the existing ADWR groundwater flow model, and to use results to plan
details of subsequent tasks. The ADWR model will be installed on Montgomery &
Associates computer system and initial simulations will be conducted. Model output
will be compared to output files obtained from ADWRto verify correct installation
and operation of the model.
Preliminary projections of groundwater levels along the Santa Cruz River will
then be conducted and results will be documented in the form of water level
hydrographs and water level contour maps for comparison to measured ground-
water levels. A meeting will be held with Tucson Water personnel, USCOE and
P TRDN project cooperators to review results of preliminary projections and to present
recommendations for refinement of the model grid. In addition to deciding the level
and method of refinement of the grid, a decision will also be made at the meeting to
either: 1) conduct groundwater flow modeling and particle tracking for the MUSF
before making modifications to the model grid spacing; or 2) proceed with
modifications to grid spacing prior to conducting groundwater flow modeling and
particle tracking for the MUSF. This decision will be made jointly with Tucson Water
based on comparisons of observed and projected water level response.

TASK 3.1: MODEL GRID REFINEMENT
The objective of TASK 3.1 is to modify the ADWR model as required to
increase resolution of projected groundwater levels and hydraulic gradients in the
vicinity of the Santa Cruz River downstream from the RRTP. Increased resolution
will be obtained by reducing grid cell spacing from 1/2-mile to approximately 1/8-mile
or smaller in the vicinity of the Santa Cruz River. Decreased grid spacing will be
accomplished either by defining a subgrid with reduced grid spacing and using the
telescopic mesh refinement technique, or by reducing grid spacing within the
regional ADWR model grid.
After the model grid has been refined, pumping and recharge will be
reassigned from rows and columns in the ADWR model grid to revised row and
column numbers in the refined grid. Other modifications will be made as required to
accommodate the refined grid and prepare to conduct model projections.
After modifications to the model have been completed, simulations will be
made for the ADWR calibration period and results for the refined model will be
compared to results for the original ADWR model to verify calibration of the refined
grid model. The model will then be used to project baseline conditions for year
1999, which will provide initial conditions for model projections under T AS KS 4.1
and 4.2.

TASK 3.2: MODIFICATION OF MODEL
Task 3.2.1: Calibrate Model to Local Conditions
The groundwater flow model will be refined, as required, based on review of
AOWR input data and results of AOWR calibration. Modifications will be made as
necessary to adequately represent rates and distribution of effluent recharge, to
correct conceptual or numerical errors in the AOWR model, and/or to improve model
calibration locally in the area of effluent recharge. Model simulations will be
conducted to evaluate effect of modification(s) on degree of correspondence
between observed and projected groundwater levels for the model calibration period,
and adjustments will be made to model hydraulic conductivity to improve model
calibration. Because the AOWR calibrated model has not yet been critically
reviewed, the level of effort required for Task 3.2.1 is uncertain. For estimating
costs, a total of approximately 400 hours of professional staff time were allocated for
conduct of model refinement.
Task 3.2.2: Optional Additional Calibration for Refined Grid

A potential exists that model calibration (T AS K 3.2.1) will be conducted in
conjunction with "Modeling for Alternative A" (TASK 4.1) using the original AOWR
unrefined model grid. TASK 3.2.2 would be conducted only if TASK 3.2.1 is

1) project groundwater levels for the period 1999 through 2025 for Alternative A;
2) project the volume of stored water that may exit the Tucson AMA during the
period 1999 through 2025, if any; and 3) project the maximum Area of Impact, as
defined by the 1-foot contour of groundwater level rise.

All model projections will include effluent recharge and recharge from other
permitted USFs located within the maximum Area of Impact for the MUSF. Results
of groundwater flow modeling will be used by Tucson Water to evaluate hydrologic
feasibility, potential for unreasonable harm, and the maximum Area of Impact; as
defined by the 1-foot groundV"v:ater level rise contour as well as water level rise
shown in hydrographs and maps. Results of particle tracking will be used to identify
the potential for stored water from the MUSF to exit the Tucson AMA prior to year
2025, and the year in which stored water may begin to exit the AMA. The
groundwater flow model will then be used to project the volume of stored water, if
any, that may exit the AMA prior to year 2025.
Draft illustrations will be prepared to document recharge volurnes and
distribution, projected water level change with time at selected locations, and
contours of projected water levels.

TASK 4.2: MODELING FOR ALTERNATIVES B - 0
The groundwater model developed under TASKS 3.1 and 3.2 will be used to
project groundwater levels for the period 1999 through 2025 for the following effluent
volumes discharged to the Santa Cruz River:
· Alternative B: All effluent
Alternative C: Non-city effluent only
· Alternative 0: County effluent only
For each alternative, draft illustrations will be prepared to document recharge
volumes and distribution, projected water level change with time at selected
locations, and contours of projected water levels.
Although the model will be constructed to allow simulation of constructed
recharge facilities by the USCOE and TRDN cooperators, and use of the model for
simulation of alternatives with constructed facilities will be described in the users
manual (TASK 6.2), model simulations conducted under TASK 4.2 will be for
passive recharge by natural infiltration in the river channel.
The groundwater flow model will be developed for use with MODFLOW-
SURF ACT, which will provide for automatic adjustment of infiltration rates if
projected water level rises to land surface. Simulated infiltration rate will decrease
as required to maintain groundwater level at a specified altitude corresponding to the
stream channel, the floor of a recharge basin, or a specified minimum depth to
groundwater level below the stream channel or a basin.

Montgomery & Associates will prepare a report documenting the groundwater
flow and particle tracking models and results of model projections. The report will be
prepared for use by Tucson Water to support application(s) to ADWR for MUSF
permits(s), and will focus on model documentation and results that are required to
address hydrologic feasibility, unreasonable harm, and maximum Area of Impact.

attend one meeting with Tucson Water and ADWR in Phoenix to facilitate
understanding of the ADWR groundwater flow model and subsequent operation of
the model using Montgomery & Associates computer system; 2) Montgomery &
Associates personnel will attend three meetings with Tucson Water, USCOE and
TRDN cooperators to present the baseline model report, the final report, and the
users manual; 3) Tucson Water will arrange for the meetings and prepare meeting
agendas, as appropriate, with input from Montgomery & Associates; and
4) Montgomery & Associates will prepare modeling-related information for review
and discussion at the meetings. All activities for TASK 7 will be conducted in close
cooperation with Tucson Water.

1. EXPERIENCE AND QUALIFICATIONS OF TEAM
Errol L. Montgomery & Associates, Inc.. has assembled a project team to provide the
experience and expertise required to conduct groundwater flow modeling for evaluation of effluent
recharge in the Santa Cruz River. Mark Cross will be Principal in Charge of the project team and will
provide overall project oversight and quality assurance, and provide technical support, as required. He.
will be the principal contact for the Montgomery & Associates project team. Hale Barter will be Project
Manager and will be responsible for maintaining continuity of service on the project and executing work
on schedule and within budget. Groundwater flow modeling will be conducted by Hale Barter with
support from Joseph Baker and Marla Odom. Jeff Meyer has extensive field experience at the project
site and will serve as a technical advisor to assist in development of the model to simulate stream
channel infiltration and aquifer recharge. An organizational chart with expected percent of total project
hours for these personnel is shown on Figure 1. Experience and qualifications of team members,
including licenses, registra~ions anp certifications, and experience on similar projects, are given in the
attached professional profiles. All project team members are from the Montgomery & Associates
Tucson office and will be continuously available to complete the project on schedule.

The Central Avra Valley Storage and Recovery Project (CAVSARP) is being constructed by the City of
Tucson for storage of Central Arizona Project water in the regional aquifer and recovery of stored water
for treatment and potable use. Facilities include constructed recharge basins, a recovery wellfield, water
conveyance systems, and monitoring facilities. Recharge operations using three 20-acre recharge basins
have been conducted since October 1997, and recovery operations commenced in 2001. Full-scale
facilities and operations will be phased in over a period of several years; ultimate recharge and recovery
capacity is planned to be 60,000 acre-feet per year.
Montgomery & Associates was retained in July 1996 as a subconsultant to Malcolm Pirnie, Inc. to provide
hydrogeologic services for CAVSARP. The scope of work for hydrogeologic services included tasks for
design and permitting of recharge and recovery facilities and groundwater monitoring facilities, public
participation, and design and construction of recovery wells. Two-dimensional groundwater flow modeling
was conducted to assist with preliminary design of recharge and recovery facilities and to support
recharge permit applications and recovery well applications. Three-dimensional groundwater flow
modeling, particle tracking, and solute transport modeling were completed in December 1999 for design

The City of Glendale, Arizona, operates a wastewater reclamation facility with a planned capacity of
15 million gallons per day. A pilot project has been in operation since mid-2000 to recharge treated
wastewater using surface basins. Montgomery & Associates was retained by Malcolm Pirnie, Inc. in 1995
to conduct hydrogeologic investigations in support of siting, designing, and permitting of the pilot recharge
facilities. Numerical modeling was conducted for projection of hydrologic impacts associated with the pilot
project. In 2001, Montgomery & Associates calibrated the groundwater flow model using pilot project
data, arid conducted modeling projections in support of a 20-year full-scale Underground Storage Facility
Permit and modification of the existing Aquifer Protection Permit.
Pima Mine Road Recharge Project, Pima County, Arizona

The Pima Mine Road Recharge Project is located in the upper Santa Cruz basin, approximately
15 miles south from Tucson, Arizona. Montgomery & Associates was retained by Central Arizona
Water Conservation District from 1996 through 2000 for preparation of a monitoring plan and
construction of monitoring facilities for the pilot recharge project, and to conduct groundwater flow
modeling to support application for an Underground Storage Facility permit for a full-scale project. Pilot
recharge facilities included approximately 14 acres of constructed recharge basins which were used to
recharge approximately 20,000 acre-feet of Central Arizona Project water over a period of 2 years. The
full-scale project is planned to include 46 acres of recharge basins. In support of the application
process, Montgomery & Associates developed and calibrated a three-dimensional variably-saturated
groundwater flow model for demonstration of recharge feasibility for the full-scale recharge project.

of Central Arizona Project water in constructed basins. As part of the application process, Montgomery &
Associates developed a regional groundwater flow model for projection of groundwater level rise resulting
from the proposed Replenishment Project, the proposed nearby PCFCD High Plains Effluent Recharge
Pilot Project, and the existing Avra Valley Recharge Project located approximately one-quarter mile south
from the Replenishment Project site. Sensitivity analyses were conducted to evaluate impacts of
variations in model parameters on projected groundwater level rise.
Northwest Tucson Active Management Area Recharge Feasibility Investigations

Montgomery & Associates was retained by Pima County Flood Control District in 1995 to assess
feasibility of artificial recharge of the regional basin-fill deposits aquifer system by surface spreading at
potential recharge sites located in the northwest part of the Tucson Active Management Area.
Investigation sites were located adjacent to a 9-mile reach of the Santa Cruz River near the Town of
Marana and a 7-mile reach of the Canada del Oro and Big Wash near the Town of Oro Valley. Potential
sources of water for recharge include Central Arizona Project water for both locations and treated
wastewater effluent for sites along the Santa Cruz River. To assess the potential areal extent of changes
in groundwater quality associated with artificial recharge of Central Arizona Project water, Montgomery &
Associates constructed groundwater flow and particle-tracking models for the proposed recharge site
along Canada del Oro Wash and Big Wash.
Members of the project team have extensive experience with development of use and
groundwater flow models to concurrently simulate both regional and local groundwater conditions, as
required for the Santa Cruz effluent recharge project. For this project, the groundwater flow model must
be able to accurately simulate the effects of recharge along the Santa Cruz River and the regional
background effects of groundwater withdrawals and natural recharge. Accomplishing this objective will
require that model grid spacing in the area of recharge be substantially smaller than the 1/2-mile grid
spacing presently utilized in the Arizona Department of Water Resources model. For previous modeling
projects conducted by Montgomery & Associates, the use of an embedded mesh, or telescopic mesh
refinement, was considered as a method for avoiding the need to simulate regional conditions with each
simulation of local conditions. For previous projects, we have favored refinement of the mesh rather than
construction of an embedded mesh within the regional model. This choice was based chiefly on
comparison of the following for the two approaches: 1) memory and execution time requirements, and
2) practicality and accuracy of representing effects of pumping or recharge stresses within the area of the
embedded mesh on boundary conditions f6r the embedded mesh. As for previous groundwater flow
models, we will evaluate the potential benefits of using an embedded mesh for the proposed effluent
recharge project, and will use this approach if appropriate or preferred.

Montgomery & Associates is a hydrogeologic consulting group providing professional services in
nearly all aspects of groundwater. Hydrogeologic services provided include planning, design,
supervision, and management of: artificial groundwater recharge projects, groundwater exploration and
development programs, remedial investigations, and monitoring programs. We have participated in
numerous groundwater recharge projects in Arizona, including projects for private industry, Arizona
Department of Water Resources, Central Arizona Water Conservation District, Pima County, local water
districts in the Tucson and Phoenix areas, the cities of Tucson and Glendale, and the Town of Prescott
Valley. Most of these projects included groundwater flow modeling to support design and permitting of
recharge facilities. Montgomery & Associates maintains a permanent staff of 34, which comprises 24
professionals and 10 support personnel. The staff includes hydrogeologists, hydrologists, geologists, soil

investigations in the Tucson basin and Avra Valley for private industry, municipalities, and other
government agencies. Because all of these investigations required characterization of hydrogeologic
features and groundwater conditions, we have developed a comprehensive knowledge base of local
hydrogeologic conditions. Montgomery & Associates has extensively investigated the Holocene alluvium,
Fort Lowell Formation, and Tinaja beds in the vicinity of the Santa Cruz River downstream from the Roger
Road Treatment Plant, as well as other areas of Tucson basin and Avra Valley. Our experience
investigating local hydrogeologic conditions is summarized below:

As part of the Tucson Recharge Feasibility Assessment for Tucson Water,
Montgomery & Associates identified favorable areas for recharge by surface
methods and by injection wells, including site-specific hydrogeologic investigations,
pilot recharge tests, and development of a database of well and aquifer properties
for more than 250 retired and active production water wells.

Project team members have conducted exploratory drilling, supervised
construction of wells, and conducted pumping tests to determine aquifer
parameters in many parts of Tucson basin and Avra Valley, including the Avra
Valley Recharge Project and Lower Santa Cruz Replenishment Project sites.

incorporate hydraulic parameters - from the U.S. Geological Survey regional

Responsiveness and Coordination with Tucson Water
Montgomery & Associates has participated in several projects with Tucson Water from 1986 to
present. These projects have included investigations of recharge feasibility, determination of aquifer
parameters, groundwater flow modeling in support of design and permitting of recharge facilities,
monitoring of groundwater conditions, evaluation of wellfield productivity for preparation of a long-term
operating plan, and projection of future groundwater conditions. In all investigations conducted for and
with Tucson Water, we have maintained a collaborative professional relationship with Tucson Water staff,
and provided quality work products on schedule and within budget., We anticipate the proposed project
will require maintaining close communication with designated Tucson Water staff, and other cooperators
throughout the duration of the project, from project scoping through model development and submittal of
work products. We believe that effective communications can be facilitated by scheduling periodic
meetings to coordinate activities and review progress toward project goals.
Project Management
A work plan will be prepared to clearly define project objectives, methods of investigation, scope of
work, schedule, budget, and deliverables for defined work phases and tasks. Particular attention will be
given to defining specific project objectives and preparing a detailed description of work scope and budget
prior to commencement of work. We will employ a project management system to track completion of
tasks within the specified project schedule. Resources will be allocated to ensure adherence to specified
completion dates. Technical review of both process and product for quality assurance will be conducted
at predetermined stages in the development of the work product. Costs will be tracked using a computer:'
based billing system which will allow monitoring of costs incurred on a task by task basis. Monitoring of
costs will be integrated with the tracking of task completion to ensure deliverable schedules are met within
budget.
To assure quality work products, Montgomery & Associates maintains a staff of experienced
professionals, emphasizes interim quality assurance and technical peer reviews, and requires review of
draft and final work products by senior staff members. Project team members have an average of
11 years of experience in hydrogeology. The high level of experience provides an excellent environment
for planning and completing the project and producing a high-quality work product that meets project

Montgomery & Associates has the resources necessary for preparing a quality work product on
schedule and within budget. A description of the project team members and their respective roles on
the project are described in the response to QUESTION 1. EXPERIENCE AND QUALIFICATIONS
OF TEAM. We maintain a permanent full-time staff of registered professionals that are available to
support the core members of the project team, as required. Our professional staff employ state-of-the-
art methodology and technology for conducting groundwater flow modeling and particle tracking. We
believe our modeling software technology and staff resources are among the best available in the
industry. The professional staff are supported by a full graphics design and drafting group utilizing the
latest in illustration and CAD software and hardware.
For groundwater flow modeling and particle tracking, we will use the graphical modeling
interface Groundwater Vistas, version 3.0, written by Environmental Simulations, Inc. (2001).
Groundwater Vistas supports both MODFLOW and MODFLOW2000, and utilizes a Telescopic Mesh
Refinement (TMR) feature to create embedded meshes in larger model grids. Groundwater Vistas
supports Path3D for particle tracking.
Internal procedures, methodologies, and methods that will be used to ensure that work will be
completed in accordance with the work quality and time requirements are described in the response to
QUESTION 3. QUALIFICATIONS OF FIRM. All project team members, equipment, and software

5.0 OTHER CONSIDERATIONS
Unique Techniques and Knowledge
Montgomery & Associates has been at the forefront of developing innovative approaches for
understanding and modeling groundwater recharge processes, A central component in these
approaches has been the investigation and simulation of low-permeability units in the vadose zone that
might impede infiltration or cause perched conditions. We have successfully used the groundwater flow
model code MODFlOW-SURFACT (HydroGeologic, Inc., 1999), to simulate impacts of low-
permeability units in the vadose zone on recharge processes. Using a simplified solution for
unsaturated flow, MODFlOW-SURFACT is capable of simulating vertical unsaturated flow and
development and lateral spreading of perched groundwater above low-permeability units. For the
Santa Cruz effluent recharge project, groundwater flow modeling would be conducted using
MODFlOW; however, limited interim use of MODFlOW-SURFACT would provide an efficient method
for assessing the potential occurrence of perched groundwater conditions beneath the Santa Cruz
River. Perched groundwater conditions can potentially limit recharge feasibility but may also support
riparian habitats that may be desired by the Tres Rios del Norte cooperators. MODFlOW-SURFACT
also includes a feature that automatically reduces infiltration rate if groundwater levels reach a specified
elevation, such as the bottom of the recharge source. This feature may prove useful for evaluation of
surface impoundment projects along the Santa Cruz River by the Tres Rios Del Norte cooperators.
Implemented as described above, MODFlOW-SURFACT input files are almost identical to MODFlOW
input files and the models would be completely interchangeable. MODFlOW-SURFACT is supported
by Groundwater Vistas.
Mark Cross has participated with Tucson Regi.onal Water Council and Southern Arizona Water
Resources Association in addressing recharge issues in the Tucson Active Management Area (AMA).
He has been an active participant in the Regional Recharge Committee convened by Arizona
Department of Water Resources to assist in preparation of a Regional Recharge Plan for the Tucson
AMA.
Both Mark Cross and Hale Barter have participated in the Rillito Recharge Feasibility Study
Technical Advisory Committee. The Rillito Recharge Feasibility Study is a comprehensive investigation
of in-stream recharge processes and feasibility for sustained artificial recharge by infiltration in the
Rillito River that includes numerical flow modeling. Participation in the Committee has provided
valuable insight to site-specific in-stream infiltration behavior which may be applicable to effluent
recharge in the Santa Cruz River.
Members of the project team are in the final stages of preparing a hydrogeologic report and
Underground Storage Facility permit application for the Town of Prescott Valley to enable the Town to
begin accruing credits for recharge of treated effluent. Discharge of treated effluent and subsequent
infiltration in the Agua Fria River has been occurring since 1993. For this project, we conducted
hydrogeologic investigations in support of applications for both managed and constructed in-channel
recharge facilities. The infiltration and recharge processes, and needs and issues associated with a
Underground Storage Facility permit application, are similar to the Santa Cruz effluent recharge project.
One of these issues is demonstration that the stored water would remain available for use in the Active
Management Area in which the water was stored. Insight gained during work on the upper Agua Fria
effluent recharge project should be valuable in conducting investigations in support of planned
Underground Storage Facility permit applications by Tucson Water.

Members of the project team have produced a "Users Manual" for application of a groundwater
flow model to simulate reclamation wellfield operations at U.S. Air Force Plant 44, for Raytheon Missile
Systems. This experience will be valuable in preparing a users manual for the groundwater flow model
for the proposed effluent recharge project.
Experience Working with Govermental Agencies Involved in Proiect
· We have had frequent interaction with Arizona Department of Water Resources
personnel (Frank Corkhill, Dale Mason, Lou Botta, and Keith Nelson) regarding
the development and status of their groundwater flow models, including the
updated model presently being prepared for the Tucson Active Management
Area. We foresee no difficulty in modifying this model for purposes of modeling
effluent recharge in the Santa Cruz River.
· We have participated in numerous preapplication meetings and have submitted
numerous hydrologic reports to Arizona Department of Water Resources in
support of Underground Storage Facility permit applications. In all cases the
permit has been issued or the permit application is still under review by the
Department. Our successful experience with the State permitting process will be
beneficial for the preparation of the reports that will be used to support
applications for permits for effluent recharge along the Santa Cruz River.
