RELATING TO DEVELOPMENT;APPROVING A RELEASE OF ASSURANCES FOR TWIN
PEAKS AND LAMBERT LANE LOTS 1 THRU 62 AND ACCEPTING PUBLIC
IMPROVEMENTS FOR MAINTENANCE
WHEREAS the final plat for"Twin Peaks and Lambert Lane Lots 1 thru 62 and Common
Area "A" (Private Streets), Common Area "B" (Natural Open Space, Drainage, Landscape,
Pedestrian, Public Sewer and Utilities) & Common Area"C" (Active Open Space)"was recorded
in the Pima County Recorder's Office on September 25, 2020, at Sequence 20202690096; and
WHEREAS the Town has a substitute third party trust assurance agreement (the
"Assurance Agreement") with Meritage Homes of Arizona, Inc. (the "Subdivider") and Title
Security Agency, LLC, under Trust No. 202052-S,recorded in the Pima County Recorder's office
on November 6,2020,at Sequence 20203110048,assuring the completion of public improvements
for Twin Peaks and Lambert Lane; and
WHEREAS the Subdivider has completed the public improvements for Twin Peaks and
Lambert Lane acceptable to Town standards in accordance with the Assurance Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana as follows:
Section 1. The Assurance Agreement is hereby released.
Section 2. The Town accepts for maintenance, a potable water system including 4,968
linear feet of potable water line, water meters, appurtenances, valves, and fire hydrants for the
above-referenced project.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
this 20th day of September, 2022.
