RELATING TO UTILITIES; AUTHORIZING TOWN STAFF TO COMPLETE THE
APPLICATION PROCESS FOR FUNDS FROM THE WATER INFRASTRUCTURE
FINANCE AUTHORITY OF ARIZONA (WIFA) AND TO INCUR DEBT NOT TO
EXCEED $4,455,413.00 FOR THE CONSTRUCTION OF THE TWIN PEAKS
INTERCONNECT PROJECT AND THE DESIGN AND CONSTRUCTION OF THE
PICTURE ROCKS INTERCONNECT PROJECT
WHEREAS the 2017 Water Infrastructure Improvement Plan (IIP) identified that
the Twin Peaks Interconnect and Picture Rocks Interconnect projects are required to meet
future water demand in Marana and to help mitigate the impacts of per-and
polyfluoroalkyl substances (PFAS) and 1,4 Dioxane for water customers; and
WHEREAS on November 15, 2021, President Biden signed into law the
Infrastructure Investment and Jobs Act(Act)which includes ten billion dollars to address
PFAS contamination in drinking water; and
WHEREAS the funds from the Act are being managed and distributed by the
Water Infrastructure Finance Authority of Arizona (WIFA); and
WHEREAS on August 16,2022,the Marana Town Council adopted Resolution No.
2022-087, approving and authorizing the Town to submit an application for funds from
WIFA to help finance the construction of the Twin Peaks Interconnect project and the
design and construction of the Picture Rocks Interconnect project; and
WHEREAS at the time the resolution was passed, Town staff did not know
whether the funds would come in the form of a grant or a loan; and
WHEREAS since August 16, 2022, Town staff learned that the Act funds
distributed by WIFA will be in the form of a loan and that the debt authorization language
contained in Resolution No. 2022-087 requires revision as a result; and
WHEREAS the Mayor and Council feel it is in the best interests of the Town and
its citizens to complete the application process for WIFA funds and to authorize the Town
to incur debt by obtaining a loan from WIFA.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF MARANA, ARIZONA, as follows:
SECTION 1. Town staff is hereby authorized and directed to perform any and all
tasks necessary or beneficial to completing the application process to obtain funds from

WIFA and to incur debt, in which the Town will borrow an amount not to exceed
S4,455,413.00 from WIFA.
SECTION 2. The loan and the loan repayments payable by the Town will be
secured by a pledge of certain excise taxes and State-shared revenues of the Town.
SECTION 3. The Town's Manager and staff are hereby directed and authorized to
undertake all other and further tasks required or beneficial to carry out the terms,
obligations, and objectives of this resolution.
PASSED AND ADOPTED BY THE Mayor and Council of the Town of Marana,
Arizona, this 20th day of September 2022.
