MARANA ORDINANCE NO. 2022.017
RELATING TO LAND DEVELOPMENT;REVISING MARANA TOWN CODE TITLE 17
(LAND DEVELOPMENT), CHAPTER 17-15 (FLOODPLAIN AND EROSION HAZARD
MANAGEMENT CODE), SECTION 17-15-10 (PROVISIONS FOR FLOOD HAZARD
REDUCTION) TO CLARIFY TIMING OF ISSUANCE OF BUILDING PERMITS AND
CERTIFICATES OF OCCUPANCY IN SPECIAL FLOOD HAZARD AREAS (SFHA);
AND DESIGNATING AN EFFECTIVE DATE
WHEREAS A.R.S. § 48-3610 provides that an incorporated city or town may
assume floodplain management responsibility in its jurisdiction and may adopt
regulations in conformance with A.R.S. § 48-3603 designed to promote the public health,
safety and general welfare of its citizenry; and
WHEREAS the Town of Marana has adopted Marana Town Code Chapter 17-15:
Floodplain and erosion hazard management code; and
WHEREAS the Mayor and Council of the Town of Marana find that the revisions
adopted by this ordinance are in the best interest of the Town of Marana and the general
public.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE TOWN OF MARANA, as follows:
SECTION 1. Marana Town Code Title 17 (Land Development), chapter 17-15
(Floodplain and erosion hazard management code),section 17-15-10 (Provisions for flood
hazard reduction) is hereby amended as follows (with deletions shown with strikeouts
and additions shown with double underlining):
17-15-10 Provisions for flood hazard reduction

E. Standards for subdivisions and commercial developments
[No revisions to subparagraphs 1 through 9]
10. When a modification or removal of a FEMA SFHA is sought for a
development, the following requirements apply:

d. A CLOMR must be submitted to and accepted by FEMA prior to
issuance of building permits for subdivision lots. Building permits
Certificates of occupancy shall not be issued on subdivision lots to be
affected by a LOMR until the LOMR has become effective.
e. A CLOMR must be submitted to and accepted by FEMA prior to
issuance of building permits for Ecommercial/industrial buildings_
Certificates of occupancy shall not be issued for commercial/industrial
buildings to be affected by a LOMR shall not be granted a building
permit until the LOMR has become effective, unless the building as
designed meets the requirements of this chapter for the prc LOMR
conditions.

SECTION 2. The various town officers and employees are authorized and directed
to perform all acts necessary or desirable to give effect to this ordinance.
SECTION 3. All ordinances, resolutions, or motions and parts of ordinances,
resolutions, or motions of the Council in conflict with the provisions of this ordinance are
hereby repealed, effective as of the effective date of this ordinance.
SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, the decision shall not affect the validity of the remaining
portions of this ordinance.
SECTION 5. This ordinance shall be effective the 31st day after its adoption.
PASSED AND ADOPTED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
Arizona, this 4th day of October, 2022.
