HomeMy WebLinkAboutCouncil Presentation 10/18/2022 - Willow Ridge Rezoning Ordinance Condition ModificationPCM2209-001Willow Ridge Zoning Ordinance Condition Modification Town Council Public Hearing October 18, 2022 October 18, 2022 Location and RequestApplicant •A.23 Studios and ADG Cortaro LLC Request •Modification of rezoning condition of Ordinance No. 2004.07 to allow two-story development within 300 feet of Cortaro Farms Road Size and Location •Approximately 3.60 acres, SWC of Cortaro Farms Road and Sandy Desert Trail •Block ‘B’ of the Final Plat Willow Ridge Current Zoning •Neighborhood Commercial (NC) 2040 General Plan •Land use category is Commercial (C) 2 Willow Ridge Rezoning 3 Proposed Modification Marana Ordinance No. 2004.07 Condition No. 6 states: ‘No two-story construction shall be provided within three hundred (300) feet of Cortaro Farms Road on the north and along the westerly property line, as delineated in the site analysis and tentative development plan.” Condition No. 7 of the Ordinance allows building heights of 24 feet on the parcels within the rezoning area that are zoned Neighborhood Commercial (NC) Applicants requests a modification to Condition No. 6, only as it applies to their property, to allow two-story construction on all of the 3.60 acre parcel 4 Staff Analysis Staff Analysis Applicants have confirmed that their two-story product is constructed at a height of less than 24 feet –the maximum allowed under the zoning A review of the site and surrounding area indicates that visibility to the north and east from Oshrin Park is probably impacted more by the two-story structures within Willow Ridge Commons The general area has changed considerably over the past 18 years including major improvements to CortaroFarms Road, the development of church sites, and the build out of Willow Ridge Commons 5 Staff Recommendation This is a discretionary item for the Town Council to consider. Should the Council choose to approve this item, staff recommends it be subject to the recommended conditions in the draft Ordinance. 6
