HomeMy WebLinkAboutCouncil Presentation - Willow Ridge Block C Rezoning and Modification TC 12/20/2022PCZ2211-001 / PCM2210-001 Willow Ridge Block C Rezoning / Modification of Rezoning Condition Town Council Public Hearing December 20, 2022 December 20, 2022 Location and RequestApplicant •Lazarus & Silvyn, PC Request •Rezone approximately .53 acres to Neighborhood Commercial (NC) •Modification of a rezoning condition of Marana Ordinance No. 2004.07 Location •Near the SEC of Cortaro Farms Road and Sandy Desert Trail •Within the 3.81 acre Block ‘C’ of the Final Block Plat for Willow Ridge Current Zoning •R-16 (Residential) 2040 General Plan •Land use category is Commercial (C) 2 Willow Ridge Rezoning Rezoning Ordinance No. 2004.07 •Adopted by the Marana Town Council on April 20, 2004 •Rezoned property from R-144 and R-36 to R-6, NC, and R-16 3 Willow Ridge Block Plat Approved Plat •The Final Block Plat for Willow Ridge approved on September 6, 2005 •Block C was platted outside of the Neighborhood Commercial zoning boundary, thus, encompassing approximately .53 acres of the R-16 zoning. 4 Willow Ridge Current Zoning 5 Modification of Rezoning Condition 6 Marana Ordinance No. 2004.07 Condition No. 6 states: ‘No two-story construction shall be provided within three hundred (300) feet of Cortaro Farms Road on the north and along the westerly property line, as delineated in the site analysis and tentative development plan.” Condition No. 7 of the Ordinance allows building heights of 24 feet on the parcels within the rezoning area that are zoned NC (Neighborhood Commercial). Applicants requests a modification to Condition No. 6, only as it applies to their property, to allow two-story construction on the 3.81 acre parcel Staff Analysis Staff Analysis Unclear why the restriction was placed on the rezoning Applicants have confirmed feasibility of a two-story product constructed at a height of less than 24 feet –the maximum allowed under the zoning A review of the site and surrounding area indicates that visibility to the north and east from Oshrin Park is probably impacted more by the two-story structures within Willow Ridge Commons The general area has changed considerably over the past 18 years including major improvements to Cortaro Farms Road, the development of church sites, and the build out of Willow Ridge Commons 7 Staff Recommendation This is a discretionary item for the Town Council to consider. Should the Council choose to approve this item, staff recommends it be subject to the recommended conditions in the draft Ordinance. 8
