HomeMy WebLinkAboutResolution 2023-082 Approving and Authorizing the Town Engineer to Execute a Right of Entry Agreement Silverbell District Park MARANA RESOLUTION NO. 2023-082 RELATING TO REAL ESTATE; APPROVING AND AUTHORIZING THE TOWN ENGINEER TO EXECUTE A RIGHT OF ENTRY AGREEMENT GRANTING PIMA COUNTY TEMPORARY ACCESS RIGHTS OVER CROSSROADS AT SILVERBELL DISTRICT PARK PROPERTY WHEREAS the Town of Marana owns and maintains the real property acquired for Crossroads at Silverbell District Park, recorded on October 25, 2000, in Docket 11411, Page 1616 in the Pima County Recorder's Office; and WHEREAS Pima County will be constructing the Continental Ranch Regional Pump Station Force Main Augmentation Project, which increases sewer conveyance capacity and adds redundancy between Pima County's Continental Ranch Regional Pump Station and Pima County's Tres Rios Wastewater Reclamation Facility; and WHEREAS Pima County has requested Right of Entry for temporary access over Town owned property for construction activities to take place on the adjacent property owned by Pima County; and WHEREAS the Mayor and Council of the Town of Marana find that the public interests are served by approving this resolution. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, authorizing the Town Engineer, on behalf of the Town, to execute the Right of Entry Agreement in substantially the form attached to and incorporated in this resolution as Exhibit A. Uda Town Clerk J'airall, Town Attorney - i MARANA AZ E STABLISHR6 19,7 00079621.DOCX/1 Resolution No.2023-082 - 1 - 8/4/2023 Exhibit A to Marana Resolution No. 2023-082 RIGHT OF ENTRY Town of Marana, an Arizona municipal corporation (the GRANTOR), hereby grants to Pima County, a political subdivision of the State of Arizona (the GRANTEE), its representatives and authorized agents,permission to enter upon the land identified by Pima County Assessor's tax parcel number 226-27-023H, as shown on the attached Exhibit A. This Right of Entry shall be for the purpose of inspecting and/or testing for hazardous contaminants, soil and foundation investigations, archaeological exploration, surveying, accessing and appraisal inspection. Grantee shall indemnify, defend and hold harmless Grantor, from any and all present or future claims, demands, and causes of action in law or equity resulting from construction, maintenance, building, and operation in connection with this Right of Entry. This permission may be revoked by Grantor upon 90 days written notice to Grantee. IN WITNESS WHEREOF, the undersigned has executed this Right of Entry on this day of , 2023.
