RELATING TO DEVELOPMENT; APPROVING AND AUTHORIZING THE TOWN
ENGINEER TO EXECUTE AND RECORD AN AMENDMENT TO THE GENERAL
NOTES ON THE COVER SHEET OF THE FINAL PLAT FOR CASAS DE MIGUEL LOTS
1-5 TO DELETE A GENERAL NOTE THAT PROHIBITS ELEVATED EARTHEN PADS
WHEREAS the Final Plat for Casas De Miguel Lots 1-5 was approved by the Town
Council on April 1, 2008, by the adoption of Marana Resolution No. 2008-47, and was
recorded in the Pima County Recorder's Office at Book 63 Maps & Plats Page 61, for
property generally located at the northwest corner of Camino de Oeste and Lambert
Lane; and
WHEREAS the cover sheet of the Final Plat includes general note 17 which
prohibits elevated earthen pads within the subdivision; and
WHEREAS the owners of all property within the Casas de Miguel subdivision
have requested that the Town remove general note 17 and allow the custom homes in the
subdivision to build on a fill pad that meets the Town's Floodplain Ordinance and
grading standards per Land Development Code Chapter 17-13; and
WHEREAS the Town Council has determined that the proposed amendment and
this process for making the amendment are the most efficient way to address the issue in
a manner that gives full disclosure of the revision to the general public and to purchasers
of lots in the subdivision, and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, that the amendment to the general notes on the cover sheet of the Final
Plat for Casas De Miguel Lots 1-5 to delete a general note that prohibits elevated earthen
pads is hereby approved in the form attached as Exhibit A to this resolution, and the
Town Engineer is hereby authorized to execute and record it on behalf of the Town.

NOTICE OF AMENDMENT TO FINAL PLAT FOR CASAS DE MIGUEL
LOTS 1-5
(Book 63 Maps & Plats Page 61, Pima County Recorder's Office)
The undersigned, who are the only parties having any fee title interest in the property depicted on
the final subdivision plat entitled "Final Plat for Casas De Miguel Lots 1-5" (the "Casas De Mi-
guel Plat") recorded in the Pima County Recorder's Office at Book 63 Maps & Plats Page 61,
with the consent and approval of the Town of Marana, hereby modifies the cover sheet of the
Casas De Miguel Plat as follows:
The "GENERAL NOTES" are hereby amended by deleting in its entirety General Note
17 which reads: "ELEVATED EARTHEN PADS SHALL NOT BE ALLOWED.
PROPERLY ENGINEERED FOOTINGS AND STEM WALLS SET TO THE
CORRECT FFE SHALL BE INSTALLED."
