HomeMy WebLinkAboutResolution 2024-034 Approving a Release of Assurances for Saguaro Reserve I at Dove Mountain Lots 1-38, 41-173 MARANA RESOLUTION NO. 2024-034 RELATING TO DEVELOPMENT; APPROVING A RELEASE OF ASSURANCES FOR SAGUARO RESERVE I AT DOVE MOUNTAIN LOTS 1-38, 41-173, BLOCK 1, AND COMMON AREAS WHEREAS the final plat for Saguaro Reserve I at Dove Mountain, Lots 1-38, 41-173, Block"1" (Future Residential) and Common Areas "A" (Private Streets) and "B" (Open Space/Drainage) was recorded in the Pima County Recorder's Office on June 17, 2021, at Sequence 20211680146 (hereinafter,the "Subdivision"); and WHEREAS the Town has a substitute third party trust assurance agreement between Cottonwood Properties, Inc., (Cottonwood), Landmark Title Assurance Agency of Arizona, LLC, as Trustee under Trust No.2107,and the Town of Marana,recorded in the Pima County Recorder's office on July 20, 2021, at Sequence 20212010620, assuring the completion of improvements for the entire Subdivision(the "Cottonwood Properties Substitute Assurance Agreement"); and WHEREAS the Town has a substitute third party trust assurance agreement between Pulte Home Company LLC, a Michigan limited liability company (Pulte), Landmark Title Assurance Agency of Arizona,LLC, as Trustee under Trust No. 18300-T, and the Town of Marana,recorded in the Pima County Recorder's office on August 6, 2021 at Sequence 20212180315, assuring the completion of improvements for a portion of the Subdivision more fully described as Saguaro Reserve I at Dove Mountain, Lots 1-38, 41-121 (the "Pulte Substitute Assurance Agreement"); and WHEREAS the Town has a substitute third party assurance agreement between Richmond American Homes of Arizona, Inc., a Delaware corporation (Richmond), Fidelity National Title Agency Inc., as Trustee under Trust No. 60,558, and the Town of Marana, recorded in the Pima County Recorder's office on August 18, 2023 at Sequence 20232300354, assuring the completion of a portion of the Subdivision more fully described as Lots 122 through 170 of Saguaro Reserve I at Dove Mountain (the "Richmond Substitute Assurance Agreement"); and WHEREAS together, Richmond Substitute Assurance Agreement, Pulte Substitute Assurance Agreement, and the Cottonwood Properties Substitute Assurance Agreement are hereinafter referred to as the "Assurance Agreements"; and WHEREAS Cottonwood, Pulte, and Richmond have completed the private improvements for the Subdivision, acceptable to Town standards in accordance with the Assurance Agreements. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. The Assurance Agreements are hereby released.
