HomeMy WebLinkAboutResolution 2024-075 Declaring and Adopting the Results of the Town of Marana Primary Election Held on July 30, 2024 and Authorizing a Recount MARANA RESOLUTION NO. 2024-075 RELATING TO ELECTIONS; DECLARING AND ADOPTING THE RESULTS OF THE TOWN OF MARANA PRIMARY ELECTION HELD ON JULY 30, 2024; CERTIFYING THE FACTS REQUIRING AN AUTOMATIC RECOUNT OF THE JULY 30, 2024 ELECTION TO THE PIMA COUNTY SUPERIOR COURT;AUTHORIZING THE FILING OF A PETITION IN PIMA COUNTY SUPERIOR COURT FOR AN ORDER REQUIRING THE RECOUNT WHEREAS the Town of Marana, Pima County, Arizona, did hold a primary election on the 30th day of July 2024, for the election of the Mayor and two Council Member seats; and WHEREAS A.R.S. §16-642(A) requires the Town Council to meet and canvass the election not less than six days nor more than 20 days following the election and A.R.S. §16-646 sets forth the required contents of the official canvass; and WHEREAS the election returns have been presented to and have been canvassed by the Town Council; and WHEREAS A.R.S. § 16-661(A) requires an automatic recount of a vote when the canvass "shows that the margin between the two candidates receiving the greatest number of votes for a particular office . . . is less than or equal to one-half of one percent of the number of votes cast for both such candidates . . ."; and WHEREAS the election returns as canvassed by the Town Council demonstrate that for one of the two Council Member seats, the margin between the two candidates is less than one-half of one percent of the votes cast for both such candidates, requiring an automatic recount for the seat in question; and WHEREAS A.R.S. § 16-662 provides that when the canvass "shows that a recount is required, . . . in the case of an office to be filled by the electors of a city or town, the city or town council of that city or town shall certify the facts requiring a recount to the superior court in the county in which the canvass was conducted." NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA as follows: SECTION 1. That the total number of ballots cast at the Town of Marana, Pima County, Arizona, July 30, 2024 primary election, as confirmed by the Pima County Elections Department, was 13,598. Resolution No.2024-075 SECTION 2. That the total number of ballots rejected at said primary election, as confirmed by the Pima County Elections Department, was 0. SECTION 3. That the total number of votes cast in each contest at said primary election, as confirmed by the Pima County Elections Department, was as follows: Office Votes Cast Mayor 11,395 Council Member 20,922 SECTION 4. That the votes cast for the candidates for Mayor were as follows: Name Vote Total Ed Honea 11,189 Write-In Candidates 206 SECTION 5. That the votes cast for the candidates for Council Member were as follows: Name Vote Total Patrick Cavanaugh 7,091 Roxanne Ziegler 6,893 Melissa Zupi 6,879 Write-In Candidates 59 SECTION 6. That it is hereby found, determined and declared of record, that the following candidates did receive more than one-half of the total number of valid votes cast, and if more candidates received a majority of the votes cast than there are offices to be filled, the following candidates received the highest number of votes pursuant to the calculations governed by Chapter 2-2 of the Marana Town Code and A.R.S. § 9-821.01, and are hereby declared elected as of the date of the general election and issued certificates of election: Mayor - Ed Honea Council Member - Patrick Cavanaugh SECTION 7. That it is hereby found, determined and declared of record, that the margin of the votes cast between the following candidates is within one-half of one percent of the total number of votes cast for both such candidates for the second Council Member seat, which triggers an automatic recount as required by A.R.S. § 16-661(A): Roxanne Ziegler Melissa Zupi Resolution No.2024-075 SECTION 8.The Town Council hereby certifies to the Pima County Superior Court the facts set forth in this resolution, including those recited in the whereas clauses above. SECTION 9. The Town Council hereby authorizes the Marana Legal Department to file in the Pima County Superior Court on behalf of the Town all necessary documents and to take all other necessary steps for purposes of complying with the automatic recount of the Towri s July 30, 2024 primary election required under A.R.S. § 16-661(A). SECTION 10. Pursuant to A.R.S. § 16-646(D), the certified permanent copy of the official canvass for all offices of the July 30, 2024, primary election shall be filed with the Town Clerk, who shall maintain and preserve it as a permanent public record.
