Regular Council meetings are usually held the first and third Tuesday of each month at 7:00 p.m. at the Marana Town Hall, although the date or time may change, or Special Meetings may be called at other times and/or places. Contact Town Hall or watch for posted agendas for other meetings. This agenda may be revised up to 24 hours prior to the meeting. In such a case a new agenda will be posted in place of this agenda. If you are interested in speaking to the Council during Call to the Public, Public Hearings, or other agenda items, you must fill out a speaker card (located in the lobby outside the Council Chambers) and deliver it to the Town Clerk prior to the convening of the meeting. All persons attending the Council meeting, whether speaking to the Council or not, are expected to observe the Council Rules, as well as the rules of politeness, propriety, decorum and good conduct. Any person interfering with the meeting in any way, or acting rudely or loudly will be removed from the meeting and will not be allowed to return. To better serve the citizens of Marana and others attending our meetings, the Council Chambers are wheelchair and handicapped accessible. Any person who, by reason of any disability, is in need of special services as a result of their disability, such as assistive listening devices, agenda materials printed in Braille or large print, a signer for the hearing impaired, etc., will be accommodated. ADJOURNMENT .,0- N 0 TOWN COUNCIL TOWN OF MARANA I 4VXRA?NA 7 MEETING 1 7 INFORMATION MEETING DATE: July 24, 2007 AGENDAITEM: 1.3 TO: MAYOR AND COUNCIL FROM: Frank Cassidy, Town Attorney SUBJECT: Resolution 2007-131: Relating to real estate; approving and authorizing the Director of Public Works to execute certain Sewer Easements that the Developer inadvertently failed to reserve when dedicating portions of Saguaro Springs to the Town of Marana and to reserve an electric easement for public and private use. DISCUSSION The Development Agreement for Saguaro Springs Development was adopted by the Town Council on April 21, 1998, by Resolution No. 98-38. On April 6, 2004 the Town Council authorized an Amended the Development Agreement with Best Associates 11, LLC. On March 7, 2006, the Saguaro Springs Blocks I - 10 & A thru D and Lots I - 9 & A and D Plat was recorded with the Pima County Recorder's Office in Map 58 at Page 23. The Development Agreement & Final Plat facilitated the transfer of Blocks A and D to the Town for public drainage and open space purposes and Block 5 for a public park. The Saguaro Springs Park was dedicated to the Town by Special Warranty Deed recorded with the Pima County Recorder's Office in Docket 12755 at Page 4378 on March 7, 2006. The Developer inadvertently failed to reserve three additional Sewer Easements as needed for the development of Saguaro Springs within Block A, D, & 5 now owned by the Town. The exhibits are referenced in Resolution Exhibits A, B and C. Additionally, the Developer failed to reserve an easement in Block D for both public and private use. The Town and the Developer are required under the terms of the original Saguaro Springs Development Agreement to undertake all things necessary, in good faith, to carry out the intention of the Development Agreement. The granting of the Sewer Easements is necessary for the project and for the benefit of the public. The granting of the easement in Block D for electric purposes benefits both the Development and a future public CIP project. Granting the three Sewer Easements and the Electric Easement will allow the Town and the Developer to carry out the overall purpose for the Development Agreement and exercise good faith and cooperation. RECOMMENDATION Staff recommends approval and adoption of Resolution 2007-131 authorizing the Director of Public Works to execute the Sewer Easements in Blocks A, D, and 5 in Saguaro Springs and to execute an Electric Easement in Block D of Saguaro Springs. Resolution 200 7-131 (Saguaro Springs-Blk A, D, 5) 712312 00 7 BB Page 2 of 2 MARANA RESOLUTION NO. 2007-131 RELATING TO REAL ESTATE; APPROVING AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CERTAIN SEWER EASEMENTS THAT THE DEVELOPER INADVERTENTLY FAILED TO RESERVE WHEN DEDICATING PORTIONS OF SAGUARO SPRINGS TO THE TOWN OF MARANA AND TO RESERVE AN ELECTRIC EASEMENT FOR PUBLIC AND PRIVATE USE. WHEREAS Saguaro Springs Blocks A, D & 5 have been dedicated to the Town for public drainage and open space purposes by the Saguaro Springs Final Plat recorded with the Pima County Recorder's Office in Map 58 at Page 23; and WHEREAS Saguaro Springs Blocks 5 has been dedicated to the Town by the Special Warranty Deed recorded with the Pima County Recorder's Office in Docket 12755 at Page 4378 on March 7, 2006, for Park purposes pursuant to the Amended and Restated Development Agreement recorded with the Pima County Recorder's Office in Docket 12278 at Page 3092 et seq.; and WHEREAS the Town and the Developer of the Saguaro Springs project now realize that three additional Sewer Easements and an Electric Easement should have been reserved prior to the dedication of Saguaro Springs Blocks A, D and Block 5; and WHEREAS execution of the easements by the Town is necessary for the Saguaro Springs project and for the public good and carries out the spirit and obligation of cooperation among the parities, as expressed in the Saguaro Springs Development Agreement and its amendments; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that the easements legally described and incorporated by this reference as Exhibit A, Exhibit B, Exhibit C and Exhibit D are hereby approved, and the Director of Public Works is hereby authorized to execute them for and on behalf of the Town of Marana. IT IS FUTHER RESOLVED that the Town's Manager and staff are hereby directed and authorized to undertake all other and further tasks required or beneficial to complete the terms, obligations, and objectives of the aforementioned easements and Development Agreement.
