MARANA RESOLUTION NO. 2007-131
RELATING TO REAL ESTATE; APPROVING AND AUTHORIZING THE DIRECTOR OF
PUBLIC WORKS TO EXECUTE CERTAIN SEWER EASEMENTS THAT THE
DEVELOPER INADVERTENTLY FAILED TO RESERVE WHEN DEDICATING
PORTIONS OF SAGUARO SPRINGS TO THE TOWN OF MARANA AND TO RESERVE
AN ELECTRIC EASEMENT FOR PUBLIC AND PRIVATE USE.
WHEREAS Saguaro Springs Blocks A, D & 5 have been dedicated to the Town for public
drainage and open space purposes by the Saguaro Springs Final Plat recorded with the Pima County
Recorder's Office in Map 58 at Page 23; and
WHEREAS Saguaro Springs Blocks 5 has been dedicated to the Town by the Special Warranty
Deed recorded with the Pima County Recorder's Office in Docket 12755 at Page 4378 on March 7, 2006,
for Park purposes pursuant to the Amended and Restated Development Agreement recorded with the
Pima County Recorder's Office in Docket 12278 at Page 3092 et seq.; and
WHEREAS the Town and the Developer of the Saguaro Springs project now realize that three
additional Sewer Easements and an Electric Easement should have been reserved prior to the dedication
of Saguaro Springs Blocks A, D and Block 5; and
WHEREAS execution of the easements by the Town is necessary for the Saguaro Springs project
and for the public good and carries out the spirit and obligation of cooperation among the parities, as
expressed in the Saguaro Springs Development Agreement and its amendments; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN
OF MARANA, ARIZONA, that the easements legally described and incorporated by this reference as
Exhibit A, Exhibit B, Exhibit C and Exhibit D are hereby approved, and the Director of Public Works is
hereby authorized to execute them for and on behalf of the Town of Marana.
IT IS FUTHER RESOLVED that the Town's Manager and staff are hereby directed and
authorized to undertake all other and further tasks required or beneficial to complete the terms,
obligations, and objectives of the aforementioned easements and Development Agreement.

Description of a Public Sewer Easement
SAGUARO SPRINGS
DESCRIPTION of a proposed public sewer easement over, under and across that certain
property known as SAGUARO SPRINGS, as described in Book 58 of Maps and Plats, Page
23, in the office of the Pima County Recorder, being located in a portion of Section 18,
Township 12 South, Range 12 East, Gila & Salt River Meridian, Town of Marana, Pima
County, Arizona. Said easement being more fully described as follows:
COMMENCING AT the Northwest comer of said Section 18 being a found 2" BCSM, from
which the North Quarter comer of said Section 18, being a found %" Iron Pipe, bears North
89*47'53" East a distance of 2525.38 feet;
Thence along the North line of said Section 18, North 89047'53" East a distance of 1294.84
feet;
Thence departing said North line, South 00'12'07" East, a distance of 2142.30 feet to a point
on the Southeasterly line of that certain property owned by Arizona Portland Cement Co., as
described in Book 593, Page 381, in the office of the Pima County Recorder, also being a
point on the Northwesterly line of Block A,. as shown on said plat, said point being the POINT
OF BEGINNING;
Thence departing said Northwesterly line, South 51012'54" East, a distance of 132.58 feet to a
point on the most ' Northwesterly corner of that certain sewer easement recorded in Docket
13048 at Page 648, in the office of the Pima County Recorder,
Thence along the Westerly line of said rei:orded sewer easement, South 36*55'19" East, a
distance of 56.71 feet;
Thence departing said line, North 81 "46'56" West, a distance of 19.24 feet;
Thence along a non-tangent curve to the left having a radius of 35.00 feet, throu?h a central
angle of 79*18'21" (the chord of which bears South 57040'19" East for a distance of 44.67 feet
with a radial line in of North 71058'51" East and a radial line out of South 07'19'29" East), for
an arc length of 48.45 feet;

30'SEWER EASEMENT
An Easement for sewer purposes over, under and across a portion of Block D as shown
on the final plat of SAGUARO SPRINGS. BLOCKS 1 THRU 10 & A THRU D AND LOTS
1 THRU 9 & A AND B as recorded in Book 58 of Maps and Plats, at Page 23, Office of
the County Recorder, Pima County, Arizona. Located in Section 18, Township 12 South,
Range 12 East, Gila and Salt River Meridian, Pima County, Arizona. Said Easement
being 30 feet in Width, 15 feet each side of the following described centedine;
COMMENCING at the Western most comer of said Block D, said point being common to
Block D, Block 5 and Saguaro Peaks Boulevard as shown on above mentioned plat;
Thence North 15*42'34" East, along the Westerly line of said Block D, a distance of
279.16 feet to the TRUE POINT OF BEGINNING;
Thence South 47034'06" East a distance of 98.83 feet;
Thence South 76058'29" East a distance of 11.74 feet to a point on the Westerly line of
Block 7 and the POINT OF TERMINUS.
The sidelines of said 30.00 foot easement to be extended or shortened to meet at angle
points and the Westerly line of Said Block D and the Westerly line of said Block 7.

Office, Pima County, Arizona. Located in Section 18, Township 12 South, Range 12 East. Said
30.00 foot sewer easement being more fully described as follows:
COMMENCING at the Northeast comer of said Section 18, a found Y2" rebar with 1 1/2n lead
cap, from which the North Quarter corner of said Section 18, a found %" iron pipe, bears South
89045'48" West, a distance of 2640.91 feet;
Thence along the Quarter Section line of said Section 18, South 89045'48" West, a distance of

Maps and Plats, Page 23, Pima County Recorder Office, Pima County, Arizona. Located in
Section 19, Township 21 South, Range 12 East. Said electric easement being more fully
described as follows:
Basis of Bearing of this description in the line between the previously found Y2" rebar with Tag
"RLS 14172" at the South Quarter corner of Section 18 and the found Y2" rebar with Tag "RLS
14172" at the Southeast corner of Section 18, bears North 89*50'37" , a distance of 2639.28
feet.
