OF PAGES: 3 SEQUENCE: 20010350434 02/21/2001 ORDIN 14:42 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 2001.04 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, ADOPTING THAT CERTAIN DOCUMENT ENTITLED "MARANA TOWN CODE, CHAPTER 7 BUILDING," AS THE SEVENTH CHAPTER OF THE OFFICIAL TOWN CODE, ADOPTING THE RULES AND REGULATIONS THEREIN AS CONTROLLING LAW OF THE TOWN OF MARANA, AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH. WHEREAS, the Town of Marana wishes to establish and codify the laws of the Town as a unified code to standardize and maintain accessible, readable, and understandable rules and procedures for the protection and security of its citizens; and WHEREAS, that document herein referred to as "MARANA TOWN CODE", CHAPTER 7 BUILDING," has been made a public record by the adoption of Resolution No. 95- 71, which outlined regulations for building and construction of the Town of Marana; and WHEREAS, it has been determined that the adoption of amendments to that public record herein referred to as 'MARANA TOWN CODE, CHAPTER 7 BUILDING" is in the best interests of the residents of the Town of Marana. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, as follows: Section 1. Those certain documents entitled "2000 International Building Code with amendments, 2000 International Residential Code with amendments, 2000 International Mechanical Code with amendments, 2000 Uniform Administrative Code with amendments, April 2000 Building Valuation data for fee assessment with amendments"; three copies 9f which are on file in the office of the Town Clerk of the Town of Marana, Arizona, said documents having been made a public record by Resolution No. 2001-22 of the Town of Marana, Arizona, are hereby referred to and made a part hereof as if fully set out in this Ordinance and are hereby adopted as law, rules and procedures for the Town of Marana. Section 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this Ordinance and portion of the Town Code. Marana, Arizona Ordinance 2001.04 Section 3. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. Section 4. Section 7-1-2 of the Marana Town Code is hereby revised to read as follows · Section 7-1-2 Building Codes Adopted The Marana Building Code, codified in this chapter, adopts by reference the 2000 International Building Code as amended, of the International Code Council, together ..with the following code documents: 1. The 1997 Uniform Administrative Code, with amendments; 2. The 1994 Uniform Plumbing Code, with amendments; 3. The 2000 International R~sidential Code, with amendments; 4. The 2000 International Mechanical Code, with amendments; 5. The 2000 International Property Maintenance Code, with amendments; 6. The 1999 National Electric Code, with amendments; 7. The 1997 Uniform Fire Code, with amendments; The April 2000 Building Valuation Data as compiled and published by the International Conference of Building Officials as the basis for the permit fee schedule. Bo The Marana Building Code adopts by reference the following local ordinances and codes; 1. 1996 Spa/Pool Code; 2. 1996 Outdoor Lighting Code; Section 5. Implementation of this ordinance as outlined in the Resolution 2001-22 would begin 30 days after adoption by the Council. If requested by the applicant the Building Official may allow the immediate use of the newly adopted codes and a permitted continuation of the repealed codes until July 31, 2001. Marana, Arizona Ordinance No. 2001.04 Page 2 of 3 Section 6. It shall be a civil infraction for any person, firm or corporation to violate any of the provisions of this Ordinance. Civil infractions shall be enforced through the hearing officer procedure provided by A.R.S. 9-462.08. Penalties for civil infractions shall not exceed the maximum penalty set forth in A.R.S. 9-240.28. Each day a violation continues shall be considered a separate offense.
