BE IT RESOLV~D BY THE ~,t~YOR AND COI~ICIL OF THE TO'~]~ OF ~,~R_,~NA ARIZONA, AS FOLIDWS: SECTION I. The Intergovernmental Agreement, a copy of which is tached and marked ~whibit A hereto, by and between the Town o£~;~rana and Pima County for services in the assignment of street addresses and related matters, hereby is approved. SECTION 2. The }~yor hereby is authorized and directed to exgcute ' hereby is a~thorized ~nd directed to coumtersign the s83ne ~nd to see to its recordinB~ in the Office of the County Recorder of Pima County, Arizona upon al~0ropriate approval and execution by the Board of Super~nlsors of ?ima County. SECTION 3. That the various Town Officers and employees be, and they hereby ~re, authorized and directed to perform all acts necessar~y or de- sirable to give effect to this resolution. SECTION 4. ',%~ERFAS it is necessary for the preservation of the peace, health ~ud safety of the Town of Narana that this resolution become im- mediately effective, an emergency is hereby declared to exist, and this resolution shall be effective immediately upon its passage and adoption. PASSED ADOPTED AND APPROVEDby the ~ayor mld Council of the Town of Nard_ha, Arizona, APPROVED AS TO FOPS{: Town Attorney INT~GOVERN~AL AGRE~ BE~VEEN THE TOWN OF ~%RANA AND PI~A COUNTY' FOR S~qVICES IN THE ASSIGNNENT OF ~STREET ADDRESSES. THIS INTERGOVERN~AL AGRE~NT, entered into pursuaut to Title 11, Chapter ?, Article 3~ A.R.S. is between the Town of ~srena (known as. "the Town" in this Agreement) end Pima County, a body politic and co ~rporate (.known as "the County" in this Agreement), which agree to the fcllowing_~ terme and conditions: (1) The purpose of this Agreement is to provide threu~ih joint Town-County action for a complete, permanent and replicable 35 millimeter master microfiche record showinE street addresses, zonings,. floodplain, special notes end other data as desired by the County and Town, for all properties included in the ~i~ps end Plats recorded in the Office of the County Recorder of Pima County~ Arizona and included in the Zoning ~.~aps for the continuing inclusion in the record of changes and additions thereto, ~ud for ready availability to and use by {he parties of the record, all as provided herein. (2) The "Town Project" shall be the duties and activities required by this Agreement necesse_~y or desirable pursuant to this Agreement to complete the correct addressing of all premises covered by subdivision plats and maps recorded in the Pima County Reeorder's Office end Zoning ~aps to the effective date of this Agreement as well as to update and complete the Zoning, Floodplatn~ Special Notes end any other data de- sired by the Town to be shown on said existing maps and plats, and the finaucial and support duties and activities in connection therewith. (3) The "perm~uent project" shall be all the other duties and me%iv!ties required by this Agreement. (4) The County will: (a) Transfer existing_addresses, from Town Records which the Town will furnish upon request, to a master ~vlar, or special black- line, copy of eve~; subdivision map and plet recorded in the Pima County Recorder's Office and of every zonin~ map to the effective dmte of this Agreement. (b) Add to such master copy the zonir~, floodplain, special notes ~ud other data the Town desires to be shown. (c) Nicrofilm and process as necessS~V to produce a complete ~ud properly sequenced compilation of addressed and armotated sub- di~ision maps and plats and zonin~ maps in permauent, replicahie, 35 millimeter master microfiche form which is jacketed~ mounted, indexed~ ~nd protectively stored. (d) Preserve in a fireproof end w~terproof vertical map storage cabinet made for such purpose the ori~inal of the ~l~r or special blackline copy of every subdivision plat end zoning map pro- cessed end maintained pursuant to this Agreement. (e) . l~n the required number of copies of each processed may .-. and plat or ~oning map off the master microfiche onto the color striped diazo c~rds, notch them appropriately, end deliver them to the Town Clmrk for distribution to participating Town Departments. Delivery will be made through the United States Postal System and/or a courier as maybe desired by the Town. (E) Provide the Town with the required number of copies of ea=h such change or addition forthwith upon incorporating the same into .the master microfiche source. (5) The To~n will: (a) Provide the County with m~lars as needed and upon request, of recorded maps and plats for use as source documents fo9 both the Town project and future changes and additions as such occur (the permanent project). (b) Pay, after receipt of appropriate invoice therefore, subject to annual appropriation of funds, the sum of $ 8.00 f~r 2~microfiehe s~%s of~ complete and duly addressed and noted subdivision maps and zoning maps of the incorporated area. (c) Pay, to the County annually as part of the permanent pro- ject, subject to anuual appropriation of Fonds, upon receipt of appropriate invoice therefore, the sum of $ 120.00 which shall con- sist of a $10.00 monthly update fee per set of microfiche for the services agreed to be provided by the County in Sections 4(f) and 4(g) (d) The Town and County shall finance the duties and activities called for in this Agreement by establishment of a budget and armual appropriation of fumds. (e) No provision of this Agreement shall be construed or in- terpreted to divest the responsibility of the Town Clerk which is imposed upon that official by the provisions of Article Chapter Town Code. Subject to that responsibility, the County shall determine and issue new addresses for existing properties as well as in newly created properties. (f) This Agreement shall become effective on the date that it is recorded in the Office of the Pima County Recorder. The per- manent project to maintain the address system and to furnish micro- fiche copies, including changes and additions,. to the Town shall continue indefinitely subject to annual appropriation of fumds and, when desired by either o~-beth' pa~ties~. s~7111~ ~view and nego- tiation. Any s~uual r.eview and negotiation shall be completed no later tha~/~_,~-~ -~ ~ ~& of each year and shall result in a report and recommendation to the County Manager and the Town (g) Either party may terminate this Agreement at any time for ~ause or convenience by giving notice in writing to the otherS party. Such termination shall be effective thirty (30) days after receipt by the Clerk of the notified party.
