HomeMy WebLinkAboutResolution 89-001 formation of the eastern interceptor community facilities district and setting a special electionRESOLUTION NO. 89-1 A RESOLUTION OF THE TOWN COUNCIL OF '£~ TOWN OF MARANA, ARIZONA ORDERING THE FORMATION OF THE EASTERN INTERCEPTOR COMMUNIT~ FACILITIES DISTRICT AND SETTING A SPECIAL ELECTION FOR T~ APPROVAL OF SAME WHEREAS the Town Council of the Town of Marana, Arizona is authorized to form a Community Facilities District pursuant to A.R.S. Section 48-701 et seq.; and WHEREAS the Town Council of the Town of Marana, Arizona did declare an intent to form a Community Facilities District on December 6, 1988 by the adoption of Resolution No. 88-33 in accordance with A.R.S. Section 48-702 for any and all purposes allowed by law; and WHEREAS notice has been given to all applicable parties pursuant to the provisions of A.R.S. Section 48-703; and WHEREAS a hearing on any objections to the formation of the proposed Community Facilities District was held on January 3, 1989 pursuant to the provisions of A.R.S. Section 48-704; and WHEREAS the Town Council at the foregoing hearing has considered any written objections and testimony and evidence presented in support of or opposition to the objections for the formation of a Community Facilities District. NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Marana, Arizona as follows: 1. That it is hereby ordered that the Eastern Interceptor Community Facilities District be formed. 2. The property to be included within the District is described on the map attached hereto and marked as Exhibit A, and in the legal description attached hereto and marked as Exhibit B. 3. The general plan for the District, previously filed with the Mararia Town Clerk, is hereby approved as filed. 4. The Eastern Interceptor Community Facilities District shall be governed by a District Board comprised of the members of the Marana Town Council, ex officio. 5. The formation of the Eastern Interceptor Community Facilities District shall be submitted to an election of the owners of land within the proposed District who are qualified voters of the State and other land owners according to A.R.S. Section 48-3043, in accordance with the provisions of A.R.S. Section 48-705(B) on April 25, 1989, from 7:00 a.m. to 7:00 p.m.. 6. The polling place for the election shall be Marana Town Hall, 12775 N. Sanders, Mararia, AZ. PASSEDAND ADOPTED by the Town Council of the Town of Marana, Arizona this 3rd day of January, 1989.
