HomeMy WebLinkAboutResolution 89-014 appointing a special prosecutor for the town and rescinding resolution 88-31RESOLUTION NO. 89-14 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MARANA APPOINTING A SPECIAL PROSECUTOR FOR THE TOWN OF MARANAAND RESCINDING RESOLUTION NO. 88-31 WHEREAS the Town of Marana is empowered, pursuant to AoR.S. Sections 9-239 and 9-240, to appoint a Town Attorney and Town Prosecutor to advise and represent the Town in various civil and criminal matters; and WHEREAS on occasion the Marana Town Prosecutor is unavailable to represent the Town either because of a conflict of interest or his absence therefrom; and WHEREAS the Marana Town Council did, on November 15, 1988, by Resolution No. 88-31 appoint the Town Attorney and the Town Prosecutor for Oro Valley as Speoial Town Prosecutors for the Town of Marana; and WHEREAS the Town of 0to Valley has replaced its former Town Prosecutor and has hired a new Town Prosecutor, Catherine M. Shovlin. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the Town of Marana, Arizona that Gary Kidd, Attorney at Law, and Catherine M. Shovlin, Attorney at Law, are hereby appointed as Special.Town Prosecutors for the Town of Marana to represent the Town of Marana in those instances when the Marana Town Prosecutor is unavailable to do so either as a result of his absence or due to a conflict of interest. BE IT FURTHER RESOLVED that any fines levied by the Marana Town Magistrate, sitting as a Magistrate Pro Tem for the Town of Oro Valley, or by the Marana Town Prosecutor, acting as Special Prosecutor for the Town of 0ro Valley, shall be remitted as and when received to the Town of Oro Valley. BE IT FURTHER RESOLVED that Resolution No. 88-31 is hereby rescinded. PASSED AND ADOPTED by the Town Council of the Town of Marana, Arizona this 17th day of May, 1989.
