A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF MARANA, ARIZONA,
/~FFIRMING FORMATION OF MARANA/I-10
COMMUNITY FACILITIES DISTRICT PURSUANT TO
A.R.S. SECTION 48-701 ET SEQ.
WHEREAS, pursuant to A.R.S. Section 48-701 et seq., the
Town of Marana is authorized to form a community facilities
district, as described in said statute; and
WHEREAS, on May 16, 1989, owners of real property, all
of which real property lies wholly within the corporate boundaries
of the Town, presented to the Council a petition seeking adoption
of a Resolution declaring the intent of the Council to form a
community facilities district; and
WHEREAS, the Council found that the said petition had
been properly executed by the owners of 100% of the property
proposed to be included within said community facilities district;
and
WHEREAS, a General Plan for said communities facilities
district, entitled "General Plan of the Eastern Marana Community
Facilities Improvement District" had been filed with the Clerk,
setting out a general description of the proposed public
infrastructure improvements for which said community facilities
district was proposed to be formed and the general areas to be
improved; and
WHEREAS, the Council found that the public convenience
and necessity required the adoption of Resolution 89-16, which
ordered that the Marana 1-10 Community Facilities District be
formed; and
WHEREAS, the Council has determined that a General Plan
for the community facilities district formed by Resolution 89-16,
entitled "General Plan of the Marana/I-10 Community Facilities
District", attached hereto and marked as Exhibit A, has been filed
with the Clerk prior to the date of this Resolution, setting out
a general description of the proposed public infrastructure
improvements for which said community facilities district was
proposed to be formed and the general areas to be improved (such
General Plan being in content identical to that filed prior to
Resolution 89-16); and
WHEREAS, the Council finds that the public convenience
and necessity requires the adoption of this Resolution with regard
to the foregoing,
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of
the Town of Marana, as follows:

A. That the Marana/I-10 Community Facilities
District was and is formed.
B. That the property to be included within the
District was and is described on the map attached hereto and marked
as Exhibit B and in the legal description attached hereto and
marked as Exhibit C.
C. That the General Plan for the District, filed
with the Marana Town Clerk, is hereby approved.
D. That the Marana/I-10 Community Facilities
District has been and shall be governed by a district board
comprised of members of the Marana Town Council, ex officio.
SECTION 2. That except as described above, the terms and
provisions of Resolution 89-16 are affirmed as of the date thereof
and are incorporated herein as if set forth at this place.
SECTION 3. That the immediate operation of this
Resolution is necessary for the preservation of the public health
and welfare. Therefore, an emergency is hereby declared to exist,
and this Resolution shall be in full force and effect from and
after its passage and approval by the Mayor and Town Council of the
Town, as required by law. This Resolution is thereby and hereby
exempt from the referendum provisions of the Constitution and laws
of the State of Arizona.
PASSED AND ADOPTED by the Mayor and Council of the Town
of Marana, Arizona, this 5th day of September, 1989.
