HomeMy WebLinkAboutResolution 90-001 regarding contract no. 2 of the santa cruz river bank protection district233,031.001.B8912.RES RESOLUTION NO. 90-01 A RESOLUTION PERMITTING AN AMENDMENT TO THE BOUNDARY OF THE SANTA CRUZ RIVER BANK PROTECTION DISTRICT, CONTRACT NO. 2 OF PIMA COUNTY, ARIZONA; AND DECLARING AN EMERGENCY WHEREAS, a portion of the Santa Cruz River Bank Protection District, Contract No. 2 of Pima County (the "District") lies within the Town of Marana; WHEREAS, pursuant to Section 48-902, Arizona Revised Statutes, a District boundary may be formed or amended within or partially within the boundary of a city or town with the consent of the city or townts governing body; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Mararia, Arizona as follows: Section 1. An amendment to the boundary of the Santa Cruz River Bank Protection Improvement District, Contract No. 2 of Pima County, Arizona, has been proposed as set forth in the attached Exhibit "A"; a portion of the District, as amended, lies within the Town of Marana. Section 2. The governing body of the Town of Marana hereby consents to the amendment of the boundary of the District. Section 3. This consent is given with the understanding that there is no property belonging to the Town within the District as amended. Section 4. This consent is further given with the understanding that no costs are or will be chargeable to the Town as a result of the formation of the District or the amendment to its boundary. Section 5. The immediate operation of the provisions of this resolution is necessary for the preservation of the public peace, health 233.031.001.B8912.RES and safety, an emergency is hereby declared to exist and this resolution shall be in full force and effect from and after its passage and adoption.
