HomeMy WebLinkAboutResolution 91-010 deferring subdivision fees for marana gardens subdivisionRESOLUTION NO. 91-10 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA DEFERRING SUBDIVISION FEES FOR MARANA GARDENS SUBDIVISION. WHEREAS THE TOWN COUNCIL OF THE TOWN OF MARANA RECOGNIZES THE NEED FOR AFFORDABLE QUALITY HOUSING IN THE TOWN; and WHEREAS THE TOWN WISHES TO ENCOURAGE NEW DEVELOPMENT WITH THE TOWN; and WHEREAS THE DEVELOPERS OF MARANA GARDENS SUBDIVISION PROPOSE TO BUILD AFFORDABLE RESIDENTIAL HOUSING WITHIN THE TOWN; and WHEREAS THE TOWN COUNCIL RECOGNIZES THE CURRENT STATE OF THE LOCAL AND REGIONAL ECONOMY AND THE DIFFICULTY IN DEVELOPING AFFORDABLE QUALITY HOUSING; NOW, THEREFORE BE IT RESOLVED AS FOLLOWS: 1. All applicable subdivision and development fees for the Marana Gardens Subdivision shall be deferred until such time as the first unit thereof shall be sold, at which time all deferred fees shall become fully due and payable. 2. The owners and developers of Marana Gardens Subdivision shall execute such documents as shall create a lien upon said property for the full amount of the deferred fees, or shall post sufficient other collateral to guarantee the payment thereof. 3. The Council has determined to defer the fees in this instance due to the unique circumstances of the current economic situation and the need for affordable residential development in the Town. This Resolution is intended solely to address this particular circumstance and shall not be construed as a Town policy for deferral of subdivision and development fees.
