A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, FOlqMAT.T.y ACKNOWLEDGING MUTUAL AGREEMENT BETWEEN THE TOWN
OF MARANA AND TRICO ELECTRIC COOPERATIVE TO PAY TH~ TOWN FOR RE-
DESIGN COSTS FOR THE SANDERS ROAD IMPROVEMENT
WHEREAS, the Town of Marana has fully executed contracts
with the Arizona Department of Transportation (A.D.0.T.) to
complete Project No. RS-247 (11) P, Sanders Road from Avra Valley
Road to the Santa Cruz Bridge via Resolution No. 92-02 approved
by the Marana Town Council on January 21, 1992.
WHEREAS, the initial design of the Sanders Road project
required the relocation of existing Trico Electric Cooperative
power poles along the West side of the present road alignment.
WHEREAS, the initial Sanders Road design required right-of-
way widths for the entire two and 1/4 miles North of Avra Valley
Road of 30 feet West of the section line.
WHEREAS, Trico Electric Cooperative's power poles for the
first 1-1/2 miles are located outside the 30 foot right-of-way,
with the exception of two poles (about 10 feet apart) near the
section corner, which are only about 15 feet West of the section
line.
WHEREAS, Trico Electric Cooperative's power poles on the
West side of Sanders Road from Avra Valley Road, North one and
1/2 miles, with the exception of one pole, (about 10 feet South
of the section corner, being 15 feet West of the Section line)
are located outside the new 30 foot right-of-way line.
WHEREAS Trico Electric Cooperative's remaining pole loca-
tions in the project's last 3/4 mile, North to the Sanders Bridge
at the Santa Cruz River, are within the Town's required 30 foot
right-of-way line West of the section line.
WHEREAS, the Town of Marana and the Trico Electric Coopera-
tive Board of Directors wish to mutually negotiate a compromise
to resolve the issue of Trico's pole relocation costs, versus the
Town's additional engineering expense to redesign the Sanders
Road alignment 10 feet further East.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of
the Town of Marana, Arizona as follows:
Trico Electric Cooperative will pay to the Town of Marana a
sum not to exceed $ 10,000 to reimburse the Town for costs
associated in the redesign of the Sanders Road Improvement to
reflect a new alignment 27 feet to the East from the section
line, (T 12S, R11 E and T 11S, R 11 E Section line between 32 and
33).
After the redesign of Sanders Road, ADOT Project RS-247
(11) P will not be affected by Trico's facilities in their
current position and after said redesign Trico's facilities will
be in compliance with all applicable codes.
And after said redesign of Sanders Road Trico's facilities
will be located outside of the new 30 foot right-of-way from Avra
Valley Road North to the Santa Cruz River Bridge.

1992.
