BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona: THAT the Mayor is hereby authorized to execute the First Amendment to the MANTIS Intergovernmental Agreement designated Contract Number 0266.90 by the City of Tucson, said amendment to become effective upon filing pursuant to A.R.S. ~ 11-952(G). MAYOR APPROVED AS TO FORM: FIRST AMENDMENT TO INTERGOVERNMENTAL AGREEMENT FOR METROPOLITAN AREA NARCOTICS TRAFFICKING INTERDICTION SQUADS This First Amendment to the Intergovernmental Agreement for the Metropolitan Area Narcotics Trafficking Interdiction Squads is entered into by and among the City of Tucson, Pima County, the Town of Oro Valley, the Town of Marana, the City of South Tucson, the Tucson Airport Authority, the Arizona Board of Regents, the Pima Community College District, and the State of Arizona. -r- W I T N E S S E T H: WHEREAS, the parties entered into an Intergovernmental Agreement for the Metropolitan Area Narcotics Trafficking Interdiction Squads which became effective September 19, 1989, the date filed with the Secretary of State (Agreement); WHEREAS, said Agreement was designated Contract Number 0266.90 by the City of Tucson; and WHEREAS, the Agreement is incorporated herein by this reference; WHEREAS, the parties wish to amend the Agreement. NOW, THEREFORE, the parties hereby agree: 1. Under this Agreement, the program will add five federally funded positions (3 Officers, 1 Financial Investigator and 1 clerical position) from the High Intensity Drug Trafficking Areas (HIDTA I) grant and continue these positions during the HIDTA II grant as well as adding three more positions (2 Officers and 1 Electronics Specialist) and certain equipment to MANTIS resources. The additional eight positions and equipment will be used by MANTIS to further its primary goal of significantly reducing unlawful narcotics activity in the metropolitan Tucson area. The additional personnel will be placed on the payroll of MANTIS participants as may be orally agreed from time to time. 2. Agencies providing grant funded positions shall not use these positions to supplant currently budgeted positions. Reimbursements will be retroactive to July 1, 1991. 3. The MANTIS Commander will inventory MANTIS, equipment needs and, subject to direction from the MANTIS Policy Board, will order equipment in accordance with Article S-E of the Agreement. Such equipment will be placed in the custody of MANTIS participants by the MANTIS Commander. 4. This Amendment may be executed in one or more identical counterparts, each of which shall be deemed an original, but all of which taken together shall constitute one agreement. 5. Except as herein modified, the terms and provisions of the Agreement shall remain in full force and effect. 6. This Amendment shall become effective upon filing pursuant to A.R.S. Sec. 11-952(G). W I T N E S S E T H: WHEREAS, the parties entered into an Intergovernmental Agreement for the Metropolitan Area Narcotics Trafficking Interdiction Squad which became effective September 19, 1989 on- the date when the agreement was filed with the Secretary of State; and the parties, having entered into a first amendment to the Intergo.vernmental Agreement which became ef f ective on September 21 j 1992, the date the First Amendment was filed with the Secretary of State; WHEREAS, said agreement was designated Contract Number 0266.90 by the City of Tucson; WHEREAS, the Intergovernmental Agreement and the First Amendment to the Intergovernmental Agreement are incorporated by 7 this reference; and =IBIT A TO RESOLUTIDN NO---Lb73A CITY OF TUCSON CONTRACT NO. PIMA COUNTY BOARD OF SUPERVISOR'S CONTRACT NO. 01-11-T-115411-1191, Amendment No. 2 WHEREAS, the parties wish to amend the agreement: NOW, THEREFORE, THE PARTIES HEREBY AGREE: 1 . The Tohono Olodham Indian Nation, pursuant to Arizona Revised Statutes (A.R.S.) Section 13-3872, and in accordance with the provisions of A.R.S. Title 11, Chapter 7, Article 3 and as authorized by appropriate action of the governing body desires to enter into the mutual aid agreement with the parties for the Metropolitan Area Narcotics Trafficking Squad. 2. The Tohono Olodham Indian Nation is empowered by the Tohono Olodham Nation Constitution to enter this contract and is empowered to maintain a police department. 3. Under this agreement, the Tohono O'odham Police Department will become a party of the Metropolitan Area Narcotics Trafficking Interdiction Squad. The Chief Law Enforcement Officer of the Tohono Olodham Police Department, or a designee, will become a voting member of the Policy Board with all powers and duties as set forth in Article 5 of the Intergovernmental Agreement. 4. One (1) police officer employed by the Tohono O'odham Police Department will be assigned to the Metropolitan Area Narcotics Trafficking Interdiction Squad in a non-grant funded position with the salary and benefits of the officer to be paid by the Tohono Olodham Police Department. The qualification and assignment of the officer will be in comp?iance with the provisions of the Intergovernmental Agreement. A second officer employed by the Tohono Olodham Police Department may be assigned to the Metropolitan Area Narcotics Trafficking Interdiction Squad when manpower and financial conditions permit such assignment in a non- grant funded position. 5. From time to time as may be necessary f or the proper enforcement of the drug and narcotics laws of the State of Arizona, officers assigned to the Metropolitan Area Narcotics Trafficking Interdiction Squad from other member agencies may be certified to enforce drug and narcotics laws on the Tohono Olodham, Indian Nation land. 6. This Second Amendment to the Intergovernmental Agreement may be executed in one or more identical counterparts, each of which shall be deemed an original, but all of which taken together shall constitute one agreement. 6. Except as modified herein, the terms and provisions of the Intergovernmental Agreement and the First Amendment to the Intergovernmental Agreement shall remain in full force and effect. 7.
