HomeMy WebLinkAboutResolution 93-035 contract with pima county to operate and maintain traffic control devices and street lightsRIq'$OLUTION NO. 93-35 A lIESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, TO CONTRACT wrrI-I PIMA COUNTY DEPARTM~.NT OF TRANSPORTATION TO OPERATE AND MAINTAIN TRAFFIC CONTROL DEVICES AND STIH=.ET LIGHTS, AND DECLARING AN EIVI~RGENCY. WHEREAS, Ordinance No. 93.12 was adopted by the Mayor and Council on September 29, 1993 annexing the area described in the map attached to the Ordinance as Exhibit A, said Ordinance to become effective at 12:01 a.m. on October 30, 1993. WHF_.REAS, the traffic control devices and streetlights within the annexed area must be operated and maintained in the interests of public safety. WHEREAS, the Pima County Department of Transportation has trained personnel capable of operating and maintaining the traffic control devices and street lights at the aforementioned intersections. WHEREAS, pursuant to A.R.S. § 11-951 et seq. the Town and County are expressly authorized to enter into intergovernmental agreements. BE IT RESOLVED by the Mayor and Council of the Town of Mararia, Arizona: 1. That the Pima County Department of Transportation be employed to maintain and operate the traffic control devices and streetlights described in detail in "Exhibit A" attached hereto and incorporated herein by this reference beginning at 12:01a. m. on October 30, 1993 until an Intergovernmental Agreement is executed by both parties or until other arrangements are made on the part of the Town to operate and maintain said traffic control devices and street lights. 2. That the Town of Marana hereby grants permission to Pima County Department of Transportation to operate within the Mararia town limits and specifically in the areas containing the traffic control devices and streetlights described in Exhibit A. 3. That the Town of Mararia agrees to compensate Pima County Department of Transportation for the above-mentioned services on a monthly basis. 4. That the Town of Mararia shall indenmify, defend and hold harmless Pima County, its officers, departments, employees and agents from and against any and all suits, actions, legal or administrative proceedings, claims, demands or damages of any kind or nature arising out of the services contemplated within this Resolution. WHEREAS, it is necessary for the preservation of the peace, health and safety of the Town of Mararia, Arizona, an emergency is declared to exist, and this resolution shall be effective immediately upon its passage and adoption.
