A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT BrlTH THE
PI2VtA COUNTY DEPARTMENT OF TRANSPORTATION TO OPERATE AND MAINTAIN
TRAFFIC CONTROL DEVICES, STREET LIGHTING, AND PERMANENT TRAFFIC
COUNTING STATIONS, AND DECLARING AN EMERGENCY.
WHEREAS, OrdNance No. 93.12 was adopted by the Mayor and Council on September
29, 1993 annexing the area described in the map attached to the Ordinance as Exhibit A, and
said Ordinance became effective at 12:01 a.m. on October 30, 1993.
WHEREAS, the traffic control devices, and street lighting, and permanent traffic
counting stations within the annexed area must be operated and maintained in the interests of
public safety.
WHEREAS, the Pima County Department of Transportation has trained personnel
capable of operating and maintaining the traffic control devices, street lighting, and permanent
traffic counting stations at the aforementioned intersections.
WHEREAS, the Marana Town Council passed Resolution No. 93-35 on October 28,
1993, expressly authorizing the activity authorized in the Intergovernmental Agreement, and this
Intergovernmental Agreement is to further codify the actions authorized in Resolution No. 93-35
into an Intergovernmental Agreement.
WHEREAS, pursuant to A.R.S. §11-951 et seq. the Town and County are expressly
authorized to enter into intergovernmental agreements.
BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona that the
Town of Mararia enter into an Intergovernmental Agreement with Pima County to provide
maintenance of traffic control devices, street lighting and permanent traffic counting stations in
the area annexed into the Town of Marana pursuant to Ordinance No. 93-12, and the Mayor is
directed to sign the Intergovernmental Agreement and any other documents necessary to fulfill
the rights and obligations thereunder.
IT IS FURTHER RESOLVED that, whereas it is necessary for the preservation of the
peace, health and safety of the Town of Marana, Arizona, an emergency is declared to exist,
and this resolution shall be effective immediately upon its passage and adoption.
