HomeMy WebLinkAboutResolution 95-068 vacating portions of cortaro road which are no longer necessary for town useRESOLUTION NO. 95-68 A RF_~OLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, VACATING PORTIONS OF CORTARO ROAD WHICH ARE NO LONGER NECESSARY FOR TOWN USE. WHEREAS, an application for abandonment of portions of Cortaro Road has been submitted to the town by an abutting land owner; and WI-IEKEAS, the Mayor and Council have the authority pursuant to A.R.S. § 28-1902 to vacate right-of-ways which are no longer necessary; and WHEREAS, it has been determined by the Mayor and Council that those portions of Cortaro Road are no longer necessary to the town due to the realignment of Cortaro Road, notice of the intended abandonment has been posted on the property and published in accordance with A.R.S. §28-1902, and that the land is of no monetary value due to its location and degree of fragmentation. BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona that the Town of Marana vacate those portions of Cortaro Road, as more fully depicted in the map attached hereto as exhibit A and incorporated herein by this reference, that are no longer necessary to the town, and the Mayor is directed to sign Quit Claim Deeds, deeding the property to the abutting land owner who is First American Title Co., Trustee, Trust No. 4559, Beneficiary, Ranch Holdings, L.L.C. PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this 19th day of December, 1995.
