MARANA RESOLUTION NO. 2002-17
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
APPROVING A REQUEST FOR A CONDITIONAL USE PERMIT BY TRICO ELECTRIC
COOPERATIVE TO BUILD AND OPERATE A 100 FOOT TALL COMMUNICATION
TOWER ON PROPERTY LOCATED AT 8600 W. TANGERINE ROAD IN THE
SOUTHEAST ¼ OF SECTION 31, TOWNSHIP 11 SOUTH, RANGE 12 EAST, ASSESSOR
PARCEL NUMBER 218-49-0110.
WHEREAS, TRICO Electric Cooperative has applied to the Town of Marana for
approval of the construction and operation of a 100 foot tall communication tower at their new
headquarter facility at 8600 W. Tangerine Road, located on the north side of Tangerine, less than
a mile east of the 1-10/Tangerine interchange, within the southeast ¼ of Section 31, Township 11
South, Range 12 East; and
WHEREAS, the existing zoning of the property is "AG" (Agriculture). Wireless
facilities are a Conditional Use within the "AG" zone subject to the requirements of Titles 10
and 23; and
WHEREAS, the Marana Planning Commission considered the request to approve the
conditional use permit on January 30, 2002, and voted unanimously to recommend that the Town
Council approve the conditional use permit; and .
WHEREAS, the Marana Town Council has heard from the representative(s) of the owner,
Town staff, and members of the public at the regular T0v~n Council meeting held March 19,
2002, and has determined that the conditional use permit should be approved with the following
conditions:
Recommended Conditions of Approval
TRICO will extend an offer of collocation to the Town of Marana. Such offer shall
be given prior to installation of tower. The Town shall notify TRICO within 30
days of their intent. Should the Town choose to collocate, TRICO shall provide the
necessary space at no expense. However, the Town shall pay for any and all
necessary studies, and engineering analysis relating to the additional load factor.
Further, the Town shall pay for the cost of installing their dish on the tower.
The Conditional Use Permit is granted for a time of ten (10) years from the date
approved by the Town Council. If TRICO intends to extend the Permit, TRICO shall
request such extension to the Town of Marana Planning and Zoning Director prior to
the expiration of the Permit.

3. In the event the tower is no longer utilized for its intended and approved
communication activities, the owner of the tower will have six months; from the
time the tower ceases to operate, t6 remove the tower in its entirety.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of fine Town of
Marana, Arizona, approving the request filed by TRICO Electric Cooperative for a conditional
use permit to allow for the construction and operation ora 100 foot tall communication tower on
tine property located at 8600 W. Tangerine Road, southeast ~A of Section 31, Township 11 South,
Range 12 East and more particularly described in Exhibit A, attached hereto and incorporated
herein by this reference, subject to the above three conditions.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
