HomeMy WebLinkAboutResolution 2002-022 release of assurance agreements in desert traditions 1MARANA RESOLUTION NO. 2002-22 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT BETWEEN PULTE HOME CORPORATION, LAWYERS TITLE OF ARIZONA, AND TOWN OF MARANA FOR LOTS 1 THROUGH 48 AND COMMON AREAS A - H, AND ACCEPTING FOR MAINTENANCE THE PUBLIC IMPROVEMENTS IN DESERT TRADITIONS I. WHEREAS, Desert Traditions I is a 14.82 acre subdivision located south of Twin Peaks Road and west of Coachline Blvd containing Lots 1 through 48 and Common Areas A - H as depicted on Exhibit A and incorporated herein by this reference, and recorded at the Pima County Recorder's Office in Book 53 of Maps and Plats, Page 95; and WHEREAS, the Town has previously entered into an Assurance Agreement between Pulte Home Corporation, (beneficiary) under Trust No. 7924-T and Lawyers Title of Arizona, (trustee), recorded at the Pima County Recorder's Office at Docket 11517, Page 4284 assuring the completion of public improvements; and WHEREAS, Pulte Home Corporation, has completed the public improvements acceptable to Town standards in accordance with the Assurance Agreement for Desert Traditions I. WHEREAS, Pulte Home Corporation, has satisfied all Linear Park financial requirements to the full satisfaction of the Town. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Section 1. Desert Traditions I, lots 1 through 48 and Common Areas A - H are hereby released fi:om the Assurance Agreement between Pulte Home Corporation, under Trust No. 7924-T, and Lawyers Title of Arizona. Section 2. The Town accepts for maintenance, including maintenance of regulatory traffic control and street signs, 0.38 miles of paved streets for the following appurtenances, as depicted on Exhibit A: a. Ceremony Place b. Desert Earth Place c. Desert Spirits Drive d. Sacred Sky Place Page 1 of 2 Marana, Arizona Resolution No. 2002-22 Section 3.
