A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,:
ARIZONA, ACTiNG AS THE BOARD OF ADJUSTMENT, GRANTiNG A VARIANCE TO
RICHMOND AMERICAN HOMES, INC. FOR THE SETBACK REQUIREMENTS OF THE
R-8 ZONiNG DESIGNATION OF THE MARANA LAND DEVELOPMENT CODE, FOR
THEIR PROPERTY LOCATED AT 8421 N. RED ROCK RIDGE COURT, WITHiN THE
CORTERO RANCH SUBDIVISION, WITHiN A PORTION OF SECTION 26, TOWNSHIP 12
SOUTH, RANGE 12 EAST, ASSESSOR'S PARCEL NUMBER 221-18-1790.
WHEREAS, Richmond American Homes, Inc. is the owner of Assessor's Parcel Number
221-18-1790, located at 8421 N. Red Rock Ridge Court, approximately one-quarter mile east of
1-10 and north of Cortero Road, and have &pplied to the Town of Marana for approval of a
variance to allow encroachment into the required 20-foot front and rear setbacks on lot 41 of the
Cortaro Ranch Subdivision; and
WHEREAS, the Marana Town Council did adopt Ordinance No. 95.30, approving the
zoning of this property as zone "R-8", and zone "VC"; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustment, finds that
strict application of the applicable Town Development Standards poses an unnecessary hardship
to the owners of this property; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustment, finds that
granting the requested variance is the minimum necessary action to afford relief; and
WHEREAS, the Marana Town Council, acting as the l~oard of Adjustment, finds that the
requested variance does not allow a use which is not pen2itted in the zoning code; 'and
WHEREAS, the Marana Town Council, acting as the Board of Adjustment, finds that the
requested variance will not cause injury to or adversely affect the rights of surrounding property
owners; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustment, finds that the
requested variance is in harmony with the general intent and purpose of the zoning code and the
specific provision for which the variance is requested; and
WHEREAS, A.R.S. § 9-462.06 authorizes the Marana Town Council, acting as the Board
of Adjustment, to grant such a variance; and
WHEREAS, the Marana Town Council, acting as the Board of Adjustment, has heard
from the representatives of the owner, staff, and members of the public at the regular Town
Council meeting held April 16, 2002, and has determined that the variance submitted by
Marana Resolution No. 2002-42

Richmond American Homes, inc. is in the best inlerest of tile residents of the Town of Marana
and should_be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona, acting as the Board of Adjustment, that the variance to allow an approximately
1.8-£oot front encroachment, and an approximately 24-inch rear encroachment into the required
20-£oot front and rear setbacks, is hereby approved.
PASSED AND ADOPTED by tile Mayor and Council oldie Town of Marana, Arizona,
