GRANT REOUEST - The Marana Police Department is requesting authorization to submit a grant to hire three additional officers for three years under the Violent Crime Contrnl and Law Enforcement Act of 1994 EXECUTIVE SESSION Pursuant to A.R.S. Section 38-431.03(A3¢3~ for discussion, consultation and legal advice with the Town Attorney regarding development agreements and community facilities districts to the property with'm the Tortolita Mount~m Properties Specific Plan, Westinghouse, and US Homes and also Pursuant toe A.R.S. Section 38-431.03 (a)(4) for discussion with the Town Attorney and to instruct it's Attorney regarding the City of Tucson vs Town of Marana law suit. Co CFD -WESTINGHOUSE/US HOMES - Discussion and action regarding the Westinghouse Properties and US Homes Corp. plans for development of a retirement community and other development within the Tortolita Mountain Properties Specific Plan, near La Cholla North of Tangerine Road. this discussion will include the planned development, community facilities district(s), past and future development agreements, financing of the projects, infrastructure to be constructed, and all other issues relating to the development. The Council will also consider, 2 discuss and take action on adoption of new development agreements and community facilities districts in the area. GENERAL ORDER OF BUSINESS r' 7 - Regulating the use of bicycle helmets for minors in the town limits of Marana Appointment of Judge Pro-Tem for Marana Municipal Court - To serve as replacement for the Town Magistrate due m Absences, Conflict, Request for Change of Judge and other Reasons Arizona Department of Liquor License & Control Application for Extension of Premises - Pizza Hut of Arizona - 4131 W. Ina Road is extending their patio dining area, which by law, requires that they apply for an Extension of Premises/Patio Permit Increase in Marana Gang Task Force Participation - Governor Symington has increased support of the Gang Task Force. Marana has been asked m participate in adding another officer from Marana and all costs and expenses will be reimbursed by the State. 2 Agenda December 6, 1994 C Resolution No. 94-39 - Entering into an Intergovernmental Agreement with the Arizona Departmem of Corrections (DOC) providing that certain individuals in DOC custody and housed at the MTC Treatment Facility will be employed by the Town of Marana in a part-time and supervised capacity. Resolution No. 94-36 - Adopftng Policy Guidelines and Application Procedures for the establishment of community facilities districts within the Marana town limits and setting application fees and provision for reimbursement of town costs and expenses ~[gJlt~[~ffill~[~ - Discussion regarding safety concerns of buildings believed to be abandoned by owner. PUBLIC HEARING AND COUNCIL ACTION - Resolution 94-38 and Ordinance No. 94.19 - Amending Development Code to add Section 07.08 titled "Development Agreements", which sets forth a policy and procedure for the adoption of Development Agreements, and adding Section 07.09 titled "Reimbursements for Public Improvements", which sets forth a policy and procedure for reimbursement to a developer for public infrastructure improvements. Resolution No. 94-38 adopts the documents as public records, and Ordinance No. 94.19 adopts the public records as law. PUBLIC HEARING AND COUNCIL ACTION - Resolution No. 94-37 & Ordiaance No. 94.18 - Amending Development Code to add Section 05.10.10 titled "Recreation Vehicle", which creates a zoning classification for recreation vehicles called Zone "RV', and to add Section 05.10.11 titled "Manufactured Housing", which creates a zoning classification for manufactured housing called Zone "MH". Resolution No. 94-37 adopts the documents as public records, and Ordinance 94.18 adopts the public records as law. Section 1-405: OrcYmance 94.16 will amend the Marana Tax Code to remove Article IV, Section 1-405, "Advertising", which will remove the ability of the Town to tax proceeds from all advertising activity. Discussion/Action Dgf~rred Compensation Plan with ICMA Retirement Corporation for Town employees Resolution No. 94-35 Discussion of Town Policies and Guidelines for applications, fees. costs, nrocedures and limitations for the formation of Community Facilities Districts within the Town limits Bike Helmet Ordinance 94.17 ~ A number of citizens have requested that the Council consider and adopting a Bike Helmet Law. WADE ROAD ABANDONMENT - An application for abandonment of Wade Road in Section 27 and 28 was filed by Robert Byall on behalf of Northern Trust Bank of Arizona, the trust Go agent for Steinfeld Trust. The portions of Wade Road that are requesting to be abandoned were removed from service due to realignment of Wade Road - Resolution No. 94-33 Call of Election Resolution No. 94-30 - Designating the election date and purpose of election; designating the deadline for voter registration; and designating the place and the last date for candidates to file nomination papers Extension of Intergovernmental Agreement contracts with Pima County for 1991. 1992 and 1993 Community Development Block Grant Programs - This will allow expenditure of allotted grant funds through June 30, 1995. Intergovernmental Agreement between the Town of Marana and Northwest Fires District/Resolution No. 94.27 - Northwest Fires Department wants to lease their 1985 Ford F350 Rescue Truck to the Marana Police Department to be used to respond to major crime scenes for $1.00 per year. Update on a request to annex three parcels of real property located at or near the intersection of Linda Vista Boulevard and Blue Bounet Road, contained in the southeastern quarter of Section 14, Township 12 south, Range 12 Update on Marana/I-10 Communities Facilities District (also known as Intersepter) by Mike Cafiso of the law firm of O'Conner, Cavanagh, Anderson, westover Killingsworth and Beshears. Resolution 94-21 - File #94-2305 - Application Richmond American Homes is requesting Plat Approval for Parcel 51 in the Continental Ranch Specific Plan. the Planning Commission recommended approval; of the Preliminary Plat, a public hearing was held by the Town Council on July I9, 1994, and the Town Council voted to request staff prepare this Resolution for passage. The Council addressed this item on August 2, 1994 and due to some confusion, regarding who will pay for a curb-cut on Silverbell Road, asked that staff work with the developer and to being it back at the August 16, 1994 meeting. G. - Slcat~ Wi0¢ Gang Tttsk Force - The Marana Police Department is requesting Council approval of RESOLUTION 94-20 which would allow Marana's participation in the Statewide Gang Task Force. The Gang Task Force will be a multi-agency, non-jurisdictional, unified law enforcement approach I intended to significantly impact gang-related activities. H. Tagging (graffiti'} in the Town Limits - Tagging in the Town limits of Marana is becoming more visible and the Council will discuss the problem and possible solutions and community involvement. I. Flood Control District Budget - Pima County Board of Supervisors met August 8, 1994 to approve the County Budget for FY 94/95 one of the items cut was the FLOOD CONTROL District budget. Marana Town Council will discuss the impact on Marana by the Counties action. J. League of Cities and Towns Festival of Towns - The Town is invited to participate in the Festival of Cities & Towns October 19, 1994 at Embassy Suites Resort in Scottsdale. GENERAL ORDER OF BUSINESS Town Magistrate Selection - Discussion and action relative to employment, salary and benefits of Town Magistrate, and selection of individual to complete the term of the outgoing Town Magistrate Public Hearing and Council Action - Applicant Granite Construction Company has applied for Specific Plan approval, setting regulations and guidelines for the excavation and processing of sand and gravel, the reclamation of land and the future industrial development Resolution No. 94-17 - File #94-2305 - Applicant Ricinnond American Homes is requesting Preliminary Plat Approval for Parcel 51 in the Continental Ranch Spenific Plan. The Planning Coramission reconunended approval of the Preliminary Plat, a Public Hearing was held by the Town Council on July 19, 1994, and the Town Council voted to request staff to prepare this Resolution for passage. Resolution No. 94-18 - At the Marana Town Council Meeting of July 19, I994, the Town Council reviewed information relating to landfills, composting, solid waste and liquid waste. At 2 the conclusion of the agenda item, the council voted to request staff m prepare a Resolution on this matter, in order to convey its position and the urgency of that message to the Pima County Board of Supervisors and the City of Tucson Council. This Resolution is now presented to the Council.
